A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, ACCEPTING
WASTE TIRE SOLID WASTE GRANT NO. WT90-41 FROM THE
FLORIDA DEPARTMENT OF ENVIRONMENTAL REGULATION
AND AUTHORIZING THE MAYOR/CHAIRMAN OF THE~BQ~RD ~

WHEREAS, by Resolution No. 197-1989, the Board of -&::ount:!y

Commissioners of Monroe County, Florida, authorize~ tne
submission of grant applications to the Florida Department of
Environmental Regulation for solid waste recycling and waste tire
grants, and
WHEREAS, the Florida Department of Environmental Regulation
has awarded Monroe County a Waste Tire Solid Waste Grant in the
amount of $24,597, and
WHEREAS, the Florida Department of Environmental Regulation
has issued Grant No. WT90-41 as part of the grant award, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that Waste Tire Solid Waste Grant No.
WT90-41 is hereby accepted and the Mayor/Chairman of the Board is
hereby authorized to execute a Waste Tire Grant Agreement in
furtherance thereof, a copy of said grant being attached hereto
and made a part hereof.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the ~ day of January, A.D. 1990.

PART II - GRANT CONDITIONS
A. GENERAL CONDITIONS:
~
1. The method of payment, for the period October 1, 1989
through September 30, 1990, will be monthly or quarterly request
for payment.
2. An original and two copies of the payment request shall be
submitted, with summaries, to the Department on a quarterly or
monthly basis. These reports shall be due on the last day of the
month following the end of the reporting period (monthly or
quarterly) .

3. You will have until October 31, 1990, to expend grant funds and
liquidate all obligations. A final request for payment must be
submitted no later than November 30, 1990. Your authority to apply
costs toward your second year grant award terminates as of October
31, 1990.
4. Expenditures shall be limited to allowable items as listed in
section 17-716.620 of the Solid Waste Grants Program Rule:

(a) Construct or operate, or contract for the construction or
operation of, a waste tire processing facility and equipment
purchases therefore;
(b) Contract for a waste tire processing facility service within
or outside the county or state;
(c) Remove or contract for the removal of waste tires from the
county, region, or state;
(d) Perform or contract for the performance of research designed
to facilitate waste tire recycling;
(e) Establish waste tire collection centers at solid waste disposal
facilities or waste tire processing facilities;
(f) Provide incentives for establishing or expanding privately
operated waste tire collection centers for the public.
5. Up to five percent of a county's grant for fiscal year 1989-
90 may be used for administrative costs and planning or research
studies to assess the feasibility of eligible projects within a
county, or to assess the feasibility of establishing a regional
waste tire program.

6. Each recipient of grant funds shall maintain accurate records
of all expenditures of grant funds and shall assure that these
records are available at all reasonable times for inspection,
review or audit by Department personnel and other personnel
authorized by the Department. Records shall be kept for a period
of at least 3 years following the end of the grant period. The
grantee agrees that it will expeditiously initiate and timely

complete the program work for which assistance has been awarded
under this agreement in accordance with all applicable provisions
of Florida statutes and the Florida Administrative Code.
7. Allowable costs incurred on or after the budget period start
date, October 1, 1989, may be charged to this agreement.
8. Grant funds shall be included in the grantee's Annual Audit
performed under the Single Audit Act (A128). Any subgrants made
by the grantee shall also include a provision for the subgranted
funds to be included in the subgrantee's Annual Single Audit. A
copy of all Single Audits shall be submitted to the Department of
Environmental Regulation, Solid Waste Section, by March 31st of
each year.

9. The Department has the right to terminate a grant award and
demand refund of grant funds for non-compliance with the terms of
the award or the Solid Waste Grants Program Rule 17-716. Such
action may also result in the Department declaring the local
government ineligible for further participation in the program
until the local government complies with the terms of the grant
award.

10. Grantee shall obtain all necessary construction-related
permits before initiating construction.
11. The grantee shall forward to the Department copies of all
contracts as they are awarded.
