Paros, ACA Division of Public Safety RESOLUTION NO. 100-1990 A RESOLUTION OF THE BOARD OF GOVERNORS OF THE LOWER AND MIDDLE KEYS FIRE AND AMBULANCE DISTRICT OF MONROE COUNTY, FLORIDA, AUTHORIZ- ING THE MAYOR TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF LAYTON AND THE LOWER AND MIDDLE KEYS FIRE AND AMBULANCE DISTRICT CONCERNING HOUSING FOR TWO (2) FIRE/RESCUE VEHICLES IN LAYTON CITY HALL. BE IT RESOLVED BY THE BOARD OF GOVERNERS OF THE LOWER AND MIDDLE KEYS FIRE AND AMBULANCE DISTRICT OF MONROE COUNTY, FLORIDA, that the Mayor is hereby authorized to execute an Agreement with the City of Layton, a copy of same being attached hereto and made a part hereof, concerning housing for two (2) fire/rescue vehicles in Layton City Hall. BY II' Attornoy's O"lce ~\~(~(: A G R E E MEN T AGREEMENT made as of the day of A.D. 19 between the City of Layton (the "City") and the Board of Governors of the Lower and Middle Keys Fire and Ambulance District (the "District"). RECITAL The City wishes to provide housing for two (2) fire-rescue vehicles in the Layton City Hall. In order to achieve this goal, and in consideration of the housing to be provided, and in order to help the District to provide fire and rescue service to the citizens of the Lower and Middle Keys, it is agreed that: 1, This is a 10-year agreement beginning on the 1st day of October, A.D. 1989 and ending on the 30th day of September, A.D. 1999. 2. The District shall pay to the City the sum of $2,400.00 per year, for the first five (5) years. Payments shall be made in equal monthly installments of $ 200.00 per month, due on the last day of every month through September 30, 1994, making a total sum of $12,000.00. The District shall pay to the City the sum of $2,640.00 per year, for the second five (5) years. Payments shall be made in equal monthly installments of $ 220.00 per month, due on the last day of every month through September 30, 1999, making a total sum of $13,200.00. 3. The city shall provide an area of 40 feet deep by 32 feet wide, making a total of 1,280 square feet of space in the City Hall for the hous ing of two (2) f ire- rescue vehicles. However, the City shall have access to the space for special events and activities upon reasonable notice to the local volunteer fire department, but that such access shall not impair or hinder the operations of the two fire rescue vehicles. 4. The District shall pay for the installation of a new truck bay door in the City Hall, for the installation of a folding partition separating the fire hall portion from the remainder of the building and any other improvements needed to house its equipment, as may be required, at a cost not to exceed $12,000.00 by bid of a licensed contractor. 5. The improvements specified in section 4 of this agreement shall be accomplished during Monroe County fiscal year 1989/90, October 1, 1989 to September 30, 1990. 6. The District shall pay the cost of all routine maintenance required in the City Hall which is attributable to the housing of the fire-rescue vehicles. A G R E E MEN T 7. The District shall be responsible for liability insurance exposures of all kinds and shall hold the city harmless from claims which may be made resulting from this agreement and are due to the negligence of the District. The City shall hold the District harmless from all claims which are attributable to the City I S negligence. The District shall also name the City as a co- insured in any insurance policies in which the District is named as insured. 8. The District shall have the option to terminate this Agreement at any time after 60 days written notice to the City. All improvements made on premises inure to the City in the event of termination.
