COMMISSIONERS AFFIRMING PLANNING h1\JNRvL t! SSION RESOLUTION NO.80-90'S RECOMMEN- DATION TO GRANT, WITH CONDITIONS A DEVELOP- MENT ORDER TO THE BIG PINE KEY MOOSE LODGE FOR AN ADDITION TO THE LODGE STRUCTURE ON PROPERTY LOCATED APPROXIMATELY 1/4 MILE NORTH OF U.S. 1 ON WILDER ROAD AND DESCRIBED AS LOT CK, PINE KEY ACRES SUBDIVISION, SECTION 26, TOWNSHIP 66 SOUTH, RANGE 29 EAST, BIG PINE KEY, MONROE COUNTY, FLORIDA WHEREAS, the Big Pine Key Moose Lodge *1585, made a proper application on 24 January 1990 to the Monroe County Planning Department for approval of a Major Conditional Use for a 1640 square foot addition to their existing meeting facilities and paid the appropriate filing and notice fees; and WHEREAS, the property is located approximately 1/4 mile north of U.S. 1 on Wilder Road and described as lot CK, Pine Key Acres Subdivision, Big Pine Key, section 26, township 66 south, range 29 east, Monroe County, Florida, approximately MM 30, and has a land use designation of Suburban Residential (SR); which designa- tion allows clubhouses as a major conditional use; and WHEREAS, the Development Review Committee reviewed the pro- posed development on 30 May 1990, and recommended approval sub- ject to compliance with the Monroe County Code, Amended and to meeting certain specified conditions; and WHEREAS, the staff report by Antonia Gerli, Planner, dated 12 June 1990 also recommended approval with conditions; and WHEREAS, the Monroe County Planning Commission held a public hearing on the proposed development on 16 June 1990; and WHEREAS, the Planning Commission at said public meeting re- viewed the Development Review Committee report, the Planning Department staff report, and heard testimony from the applicant and the public; and WHEREAS, the Planning Commission voted at said public hearing to approve the proposed addition as a Major Conditional Use sub- ject to the following conditions: 1. That a drainage plan shall be submitted prior to the issuance of a building permit; and that 2. The loading space shall be enlarged to 10 ft. X 50 ft.; and that 3. The applicant shall work with the county biologist to create a landscape plan suitable to a pineland habitat. This plan shall be approved by the biologist prior to the issuance of a building permit; and that 4. The applicant shall install a headlight shield which will contain a break to allow the Key Deer to pass along Wilder Road; and that 5. As required by Section 9.5-72(a) of the Monroe County Code, Amended, "A conditional use approval shall not be transferred to a successive owner without notification to the development review coordinator within five (5) days of the transfer"; and that 6. As required by Section 9.5-72(a) (1) of the Monroe County Code, Amended: that a. Application(s) for a building permit(s) shall be made within six (6) months of the date of the approval; and that b. All required certificates of occupancy shall be procured within two (2) years of the date of issuance of the initial build- ing permit; and WHEREAS, the Chairman of the Planning Commission has issued a Development Order for the proposed addition as Planning Commis- sion Resolution # 80-90 on 30 October 1990; and WHEREAS, according to Section 9.5-69(e) of the Monroe County Code, Amended, that development order has been placed on the 2 'Consent Agenda of this Board; and WHEREAS, no person has appealed that Development Order to this Board, and no member of this Board desires to remove the Development Order from the Consent Agenda; now THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: Section 1. That the Planning Commission Resolution/Develop- ment Order No. 80-90, including all the terms, conditions and requirements contained therein, is hereby affirmed. Section 2. That the Clerk of the Board is hereby directed to forward a certified copy of this Resolution to the Monroe County Planning Department. Section 3. That the Clerk of the Board is hereby directed to forward a certified copy of this Resolution to the Department of Community Affairs.
