ORDINANCE NO. 030 -1988
AN ORDINANCE OF MONROE COUNTY, FLORIDA,
PROVIDING FOR CODE ENFORCEMENT ISSUANCE OF
CITATIONS FOR VIOLATIONS; PROVIDING FOR A
CITATION FORM; PROVIDING FOR A SCHEDULE OF
FINES; PROVIDING FOR SEVERABILITY; PROVIDING
FOR THE REPEAL OF ORDINANCES OR PARTS THEREOF
INCONSISTENT HEREWITH; PROVIDING FOR INCORPO-
RATION INTO THE MONROE COUNTY CODE OF ORDI-
NANCES; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Chapter 76-435, Laws of Florida, an act relating to
Monroe County authorizes County building and code enforcement
officers to issue citations for violations of County ordinances;
and
WHEREAS, it is desirous that Monroe County code enforcement
officers begin to issue citations for violations of County
ordinances pursuant to Chapter 76-435, Laws of Florida; now,
therefore
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA that:
Section 1.
Monroe County code enforcement officers,
under the direction of the Code Enforcement Administrator, are
hereby designated enforcement officers for the purpose of
enforcing the provisions of the Monroe County Code pursuant to
Chapter 76-435, Laws of Florida.
Section 2.
The citations shall be uniformly printed and
prenumbered in quadruplicate and shall list by ordinance number
and section and by short, descriptive wording, the County ordi-
nance or ordinances violated, and shall indicate the name and
address of the County Court where the violation shall be tried,
the names of issuing officer and cited person, and the date of
the violation. The form of the citation shall be reviewed and
approved by the Clerk of the Court, the State Attorney, the Court
Administrator, the Chief Judge for the 16th Judicial Circuit, and
the County Administrator.
Section 3.
The County Administrator shall submit to the
Chief Judge of the 16th Judicial Circuit a recommended fine
schedule, as adopted by Resolution of the Board of County
Commissioners, in lieu of Court appearance.
Section 4.
If any section, subsection, sentence, clause
or provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 5.
All ordinances or parts of ordinances in
conflict with this Ordinance are hereby repealed to the extent of
said conflict.
Section 6.
The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 7.
This Ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary
of State of the State of Florida that this Ordinance has been
filed with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held

NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on
Tuesday, June 7, 1988, at 3:00 P.M. at the Plantation Key
Government Center, Plantation Key, Florida, the Board of County
Commissioners of Monroe County, Florida, intends to consider the
adoption of the following County ordinance:

Pursuant to Section 286.0105, Florida Statutes, notice is
given that if a person decided to appeal any decision made by the
Board with respect to any matter considered at such hearings or
meetings, he will need a record of the proceedings, and that, for
such purpose, he may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.
Copies of the above-referenced ordinance are available for
review at the various public libraries in Monroe County, Florida.
