ORDINANCE NO. 045 -1988 '.- I i~ ORDINANCE AMENDING ORDINANCE NO. 031-1988, SEC. 13(b), IN ORDER TO PROVIDE THAT THE c'-c't!JREE BOARD OF COUNTY COMMISSION MEMBERS ~~NSTITUTE THE GOVERNING BODY OF THE DISTRICT l:$US TWO CITY COMMISSIONER MEMBERS FROM ONE dlTY, EITHER KEY COLONY BEACH OR LAYTON, IF ONLY ONE CITY PARTICIPATES BUT ONE CITY COMMISSION MEMBER ONLY FROM EACH CITY IF BOTH CITIES PARTICIPATE IN THE DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVID- ING FOR INCORPORATION INTO THE MONROE COUNTY CODE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA; Section 1. Ordinance No. 031-1988, Section 13(b), is hereby amended to read as follows: b) Upon the passage of such an ordinance by one of the cities the governing body of the District shall consist of three members of the board of county commissioners and two members of the governing body of the city; if both cities elect to become part of the district, the governing body of the district shall consist of the three members of the board of county commissioners and one member from each of the cities. In either case, the county and city(ies) shall designate their representatives on the district governing body by resolution. If none of the cities choose to be included within the district, the chairman of the board of county commissioners shall be chairman of the district governing body; if any of the cities choose to be included, the chairman shall be elected by the district governing body for a one year term which may be successive. Three members of the district governing body constitute a quorum. A quorum shall be necessary for the transaction of business. The chairman shall vote at all meetings of the district governing body. Section 2. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment the'reto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance shall be filed with the Office of the Secretary of State of the State of Florida, but, in addition to the acknowledgement of its receipt in the Office of the Secretary of State, the Ordinance shall not take effect until the 30th day of September, 1988.
