Ordinance 055-1988 Monroe County Commission ORDINANCE NO. 055 -1988 AN ORDINANCE AUTHORIZING THE CLERK OF THE CITY OF KEY WEST, FLORIDA, THROUGH THE CLERK OF THE COUNTY COURT OR THE TRAFFIC VIOLATIONS BUREAU TO TRANSMIT TO THE TAX COLLECTOR OF MONROE COUNTY, FLORIDA, THE NAMES OF PERSONS WHO HAVE ACCUMULATED FIVE OR MORE CITY PARKING VIOLATIONS; DIRECTING THE TAX COLLECTOR NOT TO ISSUE ANY LICENSE PLATES OR REVALIDATION STICKERS TO SUCH PERSONS UNTIL THE PARKING TICKETS HAVE BEEN PAID; PROVIDING THAT THE CLERK OF THE COUNTY COURT AND THE TAX COLLECTOR MAY EACH RETAIN A FEE AS PRESCRIBED BY STATUTES OF THE PARKING FINES SO COLLECTED FOR ADMINISTRATION EXPENSES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: Section 1. Pursuant to Florida Statutes Section 316.1967(6), the City Clerk of the City of Key West, Florida, is hereby authorized to supply on a monthly basis to the Tax Collector of Monroe County, Florida, through the Clerk of the County Court of Monroe County, Florida, or the traffic violations bureau of Monroe County, Florida, an alphabetized list of persons who have five or more outstanding city parking violations. Section 2. Pursuant to Florida Statutes Section 320.03(8), the Tax Collector shall not issue any license plate or revalidation sticker to any person whose name appears on the list referred to in Section 1, above, until such person's name no longer appears on such list or until he or she presents a receipt from the City of Key West Department of Revenue showing that such parking fines have been paid. Section 3. The Clerk of the County Clerk and the Tax Collector shall each be entitled to a fee as prescribed by statutes of all monies collected pursuant to Section 2, above, as costs for implementing and administering this Ordinance. Section 4. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 5. All ordinances or parts of ordinances in con- flict with this ordinance are hereby repealed to the extent of any such conflict. Section 6. The provisions of this ordinance shall be incorporated into the Monroe County Code as an addition or amendment thereto and shall be appropriately numbered to conform with the uniform numbering system of the Code. Section 7. This ordinance shall take effect immediately upon receipt of official notice from the office of the Secretary of State of the State, Florida, that this ordinance has been filed with said office.
