RESOLUTION NO: 127
A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, OPPOSING FLORIDA HOUSE
BILL 883 AND FLORIDA SENATE BILL 476, WHICH, IF PASSED,
WOULD REMOVE MOST LOCAL JURISDICTION OVER
VACATION RENTAL PROPERTIES IN THE CITY OF KEY WEST,
COUNTY OF MONROE, AND THE STATE OF FLORIDA.
WHEREAS, the Florida legislature is considering HB883 and SB476, which would
redefine "vacation rental" properties as standard residential property; and
WHEREAS, the Board of County Commissioners is concerned about the potentially
adverse social and economic impact of HB883 and SB476 on Monroe County; and
WHEREAS, Monroe County and its unincorporated areas have long struggled with a
critical shortage of affordable housing for its residents. Several studies have attributed one
reason f'or this chronic shortage to the disproportionately high ratio of residential housing stock
which is owned as a "second home," used to generate revenue for absentee owners as a
vacation rental (licensed or not); and
WHEREAS, the Board of County Commissioners also recognize that it is essential to
regulate transient accommodation locally, including vacation rentals, to minimize the adverse
impacts of excessive noise, inadequate parking, increased demand on public services, and to
ensure the safety and general enjoyment of both residents and transient visitors in our
neighborhoods; and
WHEREAS, as indicated in the legislative staff reports, the bills as currently proposed
would remove authority for local governments to ban or restrict vacation rentals; and
WHEREAS, the hotel industry in Monroe County is tightly regulated to ensure guest
safety, health, access and security and is a vital component of our economy, employing
thousands of residents and generating millions of dollars in property, sales and bed taxes
annually. HB883 and SB 476 could create thousands of non - conforming accommodations and
negatively impact the hotel market; and
WHEREAS, an amendment has recently been made to SB 476, providing for
grandfathering of existing ordinances, but which would not allow the ordinances to be changed
if and when experience indicates that some modification to an ordinance is necessary;
NOW THEREFORE, be it resolved by the Board of County Commissioners of
Monroe County as follows:
Section 1: That the Monroe County Board of County Commissioners strongly oppose
proposed HB883 and SB476.
Section 2: That the Clerk of Courts is hereby authorized to transmit a certified copy of this
Resolution to Representative Saunders, Senator Bullard, and Governor Rick Scott and
members of the House and Senate leadership.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida at a regular meeting of said board held on April 20, 2011.
