DWELLING UNIT = ALLOCATIONS FOR PROPERTY DESCRIBED ASS; ? ce„ ce7 MANDALAY PB 1-194 KEY LARGO PT SQUARE 3, r`, ;, i REAL ESTATE NUMBERS 00554720.000000 AND ;; 00554720.000100 FOR A PROJECT AT 104 FIRST :w; - STREET (MANDALAY) TO BE CONSTRUCTED BY —:: _ � HABITAT FOR HUMANITY OF THE UPPER KEYS. 1 ; ` , 0 WHEREAS, at its meeting of May 16th, 2007, the Board of County Commissioners (BOCC) approved Resolution 184-2007 reserving sixty-nine (69) affordable housing allocations for four unspecified County projects; and WHEREAS, at its meeting of March 18th, 2009, the BOCC approved Resolution 083-2009 reserving ten (10) more affordable housing allocations for unspecified County projects; and WHEREAS, one of the projects for which allocations were reserved is located on RE: #00554720.000000 and'00554720.000100, Mandalay PB 1-194 Key Largo PT Square 3, for Habitat for Humanity of the Upper Keys (HHUK) to construct.a project at 104.First Street(Mandalay) which was originally for fourteen(14)units ; and WHEREAS, HHUK entered into a 99-year lease with Monroe County on May 20, 2009, for property described as Mandalay PB 1-194 Key Largo PT Square 3, Real Estate Numbers 00554720.000000 and 00554720.000100 for the project; and WHEREAS, HHUK now anticipates developing seven (7) residential units; therefore, seven (7) affordable housing allocations need to be reserved for the project; and WHEREAS, the Second Amendment to the Occupancy Agreement and Ground Lease was approved March 21, 2012, which changed the number of units for the Mandalay project to seven(7); and ' WHEREAS, Resolution 210-2009 passed July 15, 2009 reserved fourteen (14) allocations for Mandalay until June 1, 2011, which allocation reservation has now expired; and Mandalay 00554720 Reso June 20 2012 sg WHEREAS, the reservation of affordable housing allocations for the anticipated project does not exempt the project from applicable requirements for the Monroe County Land Development Regulations, Building Code and other regulatory requirements; and WHEREAS, HHUK shall obtain all required approvals from the Monroe.County Planning&Environmental Resources Department for the project; and WHEREAS, HHUK according to the Second Amendment to Occupancy Agreement and Ground Lease shall obtain permits for all affordable housing dwelling units by June 1, 2018; if the permits are not issued, the allocations will revert to the County; and WHEREAS, the project mentioned above is still in process and the allocations are still required; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Seven (7) affordable housing allocations are reserved for HHUK and HHUK has until June 1, 2018, to obtain building permits. Section 2. This resolution is retroactive to June 1, 2011, PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,Florida at a regular meeting held on the 20th day of June, 2012.
