Resolution 389-2014RESOLUTION NO. 389_2014 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS RESERVING FORTY-TWO (42) AFFORDABLE HOUSING DWELLING UNIT ALLOCATIONS FOR GORMAN & COMPANY, INC. FOR USE ON PROPERTY LOCATED AT MILE MARKER 105, KEY LARGO, RE # 00084260-000100; SETTING TERMS AND CONDITIONS. WHEREAS, on October 29, 2014, RC3 WORLD submitted a request to re-establish and reduce the number of affordable housing reservations for Gorman & Company, Inc. (Gorman), Paradise Point Senior Housing Project at (RE # 00084260-000100) approximately MM 105 in Key Largo; and WHEREAS, the Board of County Commissioners previously reserved fifty (50) affordable housing allocations (very low, low and median income categories) in Resolution 261-2013 unitl July 31, 2014; and WHEREAS, the October 29, 2014, RC3 WORLD submission reduces the requested reservation for affordable housing allocations (very low, low and median income categories) to forty-two (42) units; and WHEREAS, Gorman has applied for and intends to use low income housing tax credit (LIHTC) financing and other state and federal assistance to finance and construct the project and qualifies for the reservation of forty-two (42) affordable housing ROGO allocations as provided in MCC Sec. 138-24(b)(2); and WHEREAS, Monroe County Code Section 138-24(b)(2) authorizes reservations for affordable housing ROGO allocations as follows for: "(2) Specific affordable or employee housing projects participating in a federal/state housing financial assistance or tax credit program or receiving some form of direct financial assistance from the county upon written request from the project sponsor and approved by resolution of the board of county commissioners." and WHEREAS, Monroe County Code Sec. 138-24(b) allows the reservation of affordable ROGO allocations by the Board; however, building permits must be picked up within six months of the reservation, unless otherwise authorized by the Board; and WHEREAS, there currently exists a balance of 226 affordable housing allocations (114 allocations very low, low, & median category and 112 allocations moderate category) at the conclusion of Quarter 1 Year 23 (October 14, 2014); and WHEREAS, the current affordable housing allocation 226 balance does not include the previously reserved fifty (50) allocations for Gorman which has now expired; and WHEREAS, the reservation of affordable housing allocations for the anticipated project does not exempt the project from applicable requirements in the Monroe County Land Development Code, and other regulatory requirements; and Page 1 of 2 rlb WHEREAS, the Monroe County Planning Commission approved a Minor Conditional Use Permit Resolution on April 15, 2014, as memorialized in Resolution P14-14, allowing the development of an institutional residentrial use including 47 deed- restricted affordable housing units; and WHEREAS, the Planning and Environmental Resources Director approved a Minor Deviation to the Minor Conditional Use modifying the project boundary and reducing the approved number of affordable housing units from forty-seven (47) to forty-two (42); and WHEREAS, the reservation of these allocations for a period of greater than six months is necessary to correspond to the financing requirments for the federal/state financial assistance program utilized by Gorman; NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS: Section 1. Forty-two (42) affordable housing ROGO allocations in the very low, low, and median category are reserved for the use of Gorman & Company, Inc. and its successors in interest until November 18, 2015. Seciton 2. All building permits associated with the above allocations shall be picked up by November 18, 2015.
