Resolution 214-20172 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 MONROE COUNTY, FLORIDA MONROE COUNTY BOARD OF COUNTY COMMISSIONERS RESOLUTION NO. 214 -2017 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS ENACTING A 60 -DAY TEMPORARY EMERGENCY SUSPENSION OF THE ACCEPTANCE AND PROCESSING OF APPLICATIONS TO THE PLANNING & ENVIRONMENTAL RESOURCES DEPARTMENT; PROVIDING FOR AN EFFECTIVE DATE OF SEPTEMBER 5, 2017. WHEREAS, the Board of County Commissioners is the legislative body of Monroe County, Florida; and WHEREAS, the Monroe County Mayor declared a State of Local Emergency on September 5, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe County" and that the County "may require expedient action in order to protect the health, safety and welfare of the community;" and WHEREAS, Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys on September 10, 2017, causing substantial damage to and loss of property; and WHEREAS, the Monroe County Mayor issued another declaration a State of Local Emergency on September 12, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe County" and that the County "may require expedient action in order to protect the health, safety and welfare of the community;" and WHEREAS, during the initial recovery phase, County staff are prioritizing the acceptance, review and issuance of emergency building permits in order to provide expedient action in order to protect the health, safety and welfare of the community; and WHEREAS, as such, the Planning & Environmental Resources Department must shift its focus to assist in the processing of emergency building permits and will temporarily suspend the acceptance and processing of the Department's applications, with some exceptions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. The Monroe County is enacting a 60 -day temporary emergency suspension of the acceptance and processing any new Planning & Environmental Resources 1 Department applications for development approval, including ROGO and 2 NROGO applications, for a 60 -day period beginning on September 5, 2017 and 3 ending on November 4, 2017, except for the following applications that may be 4 needed during the County's initial recovery and emergency building permit phase: 5 6 1. ROGO Exemption Requests; and 7 2. Requests for Letter of Development Rights Determination (LDRD) 8 9 Section 2. Pending applications submitted to the Department prior to September 5, 2017 will 10 be placed on hold during the 60 -day suspension. Any required deadlines for 11 mandatory submission requirements for suspended for 60 -days. 12 13 Section 3. Planning Commission, Development Review Committee and Historic 14 Preservation Commission hearings are suspended for a 60 -day period beginning 15 on September 5, 2017 and ending on November 4, 2017. 16 17 Section 4.
