AGENDA ITEM WORDING: Approval of an Inter Local Agreement (ILA) between the Village
of Islamorada and Monroe County. The purpose of the ILA is to establish the division of
responsibilities, capital and operating costs of the Sanitary Wastewater Connection of the County's
Public Library which is shared with the Village fire station and park system.
ITEM BACKGROUND: Approval of an ILA between Monroe County and Village of Islamorada
sharing the costs for ongoing maintenance of the waste water system. The Islamorada Fire House,
the County's Library in Islamorada, and the Library Beach Park share a septic system. When the
municipal system was put into service the Village of Islamorada proposed to have one grinder lift
station for the property. Splitting the cost decreased the initial cost of installation and ongoing
maintenance.

($600.00). The annual County Portion is estimated to be Two Hundred Dollars and No Cents

FOR INSTALLATION, CONTROL, OPERATION AND MAINTENANCE OF THE
SEWER LIFT STATION TO SERVICE THE COLNTV PUBLIC LIBRARY IN
ISLAMORADA
THIS INTERLOCAL AGREEMENT is entered into this — day of
pursuant to Section 163.0 L F. .W by and between Monroe County, a political subdivision of the
State of Florida, (the "County"), and the Islamorada, Village of Blends, a municipal corporation
of the State of Florida (the "Village"),
WHEREAS, the County is authorized by Section 125.01(l)(c), F.S., to provide and
maintain County buildings and iacilities; and
WHEREAS, the County Public Library is connected to the Village wastewater collection
system; and
WHEREAS, the County will fund one third of the cost of the wastewater collection
system installation in an amount of Seven Thousand Three Hundred and Ten Dollars and No
6ents, x$7.31 0. 00), and
WHEREAS, the Village will be responsible for the ownership. control. maintenance and
operation of the sanitary lift station part of the wastewater collection system for a projected and
estimated annual cost of Six Hundred Dollars and No Cents ($600.00); and

WHEREAS, the County will be responsible for the maintenance and operation of the
lateral piping connections from the sanitary lift station to the Countv*s Public Library, and all
costs associated with such maintenance and operation; and
NOW THEREFORE, in consideration of the mutual covenants, representations, and
promises set forth in this Agreement and for other good and valuable consideration each to the
other, receipt of which is hereby acknowledged by each party, the County and the Village hereby
agree, stipulate, and covenant as follows:
PURPOSE OF INTERLOCAL AGREEMENT, The purpose of this Agreement is to establish
the division of responsibilities, capital and operating costs of the Sanitary Wastewater Connection
of the County's Public Library to the Islamorads, Wastewater Collection System.
WARRANTIES, REPRESENTATIONS, AND COVENANTS. The Village and the County
warrant, represent, and covenant that: (a) They have the full power to enter into this Agreement
and to comply with the provisions hereof, (b) The Village is the owner of the Sanitary Lift Station
System.

COVENANT OF NO INTE REST. 'rhe parties covenant that neither presently has any interest,
and shall not acquire any interest. which would conflict in any manner or degree with its
performance under this regiment, and that only interest of each is to perform and receive
benefits as recited in this Agreement.
FLORIDA CODE OF ETHICS, The parties agree that their officers and employees will be
required to comply with the standards of conduct for public officers and employees as delineated
in Section 1123 13, 1 { . , regarding, but not limited to, solicitation or acceptance of gifts: doing
business with one's agency, unauthorized compensation, misuse of public position, conflicting
employment or contractual relationship; and disclosure or use of certain information.

EXECUTION IN COUNTERPARTS. 'Flus Agreement may be executed in any number of
counterparts, each of which shall be regarded as an original, all of which taken together shall

ASSIGNMENT. Neither the Village nor the County shall have the power to assign rights or
obligations created by this Agreement to any third party without the prior written consent of the
other party. All of the obligations of this Agreement will extend to and bind the legal
representatives, successors and assigns of the Village and the County
AMENDMENT OF AGREEMENT, This Agreement may be amended only in a WTiting signed
by an Authorized Representative of each of the parties hereto.
