AGENDA ITEM WORDING: Approval of Third Lease Amendment to reflect current owner and
Landlord of the property as Old Town Trolley Tours of Washington, Inc., and amend the notice
requirement.
ITEM BACKGROUND: The Original Lease Agreement with Strombus Corporation dated March
15, 2011, is for a five year term for office space in Key West for the Public Defender's Office. A
Lease Extension and Amendment Agreement was approved on February 18, 2015, for a four year
extension. Strombus Corporation sold the property to Old Town Trolley Tours of Washington, Inc.
on April 7, 2015, and assigned this lease to Old Town Trolley on April 15, 2015 with an Acceptance
of the Assignment on April 20, 2015. A Second Lease Amendment was approved with Old Town
Trolley on September 16, 2015, but the sale was inadvertently omitted in said Amendment to reflect
that Old Town Trolley was the new owner and Landlord. This Third Lease Amendment is to
acknowledge Old Town Trolley as the current owner and Landlord under its Acceptance of the
Lease and to amend Paragraph 26 of the Original Lease as to the Notice Requirement.
PREVIOUS RELEVANT BOCC ACTION:
March 16, 2011 BOCC approved the underlying Original Lease with Strombus
Corporation for office space at 801 Eisenhower Drive for the Public
Defender.
February 18, 2015 BOCC approved a Lease Extension with Strombus Corporation extending
the lease term through March 31, 2019.
September 16, 2015 BOCC approved a Second Lease Amendment with Old Town Trolley
Tours for the office space the County leases in Key West for the Public
Defender to include an additional 2,146 sq. ft. in the current space.
