Schofield and the property located at 114 W. Avenue A., Key Largo Florida, to seek compliance with the County Codes and enforce a lien arising from code compliance case number CE10040067. ITEM BACKGROUND: This property is the subject of a Code Compliance case for the failure to remedy the unsafe condition as a result of two (2) abandoned deteriorating non-conforming structures violating two (2) County Ordinances. Compliance will be achieved by either obtaining a permit to demolish the offending unsafe structures/structural parts, or obtaining approvals, permits and inspections to bring the unsafe structures/structural parts current with existing codes as directed. On August 26, 2010 the Code Compliance Special Magistrate entered a [[1667,1752,1943,1809][12][,I,][Times New Roman]]Final Order [[1912,1752,1962,1809][12][,,][Times New Roman]] [[1925,1752,2212,180 9][12][,,][Times New Roman]]approving a [[225,1809,709,1866][12][,I,][Times New Roman]]Stipulation Agreement [[674,1809,724,1866][12][,,][Times New Roman]] [[686,1809,1536,1866][12][,,][Times New Roman]]between Mr. Schofield and the County, a Compliance was not achieved by the agreed upon date. Therefore, the parties entered into a [[225,1924,1246,1981][12][,I,][Times New Roman]]Stipulation For An Extension Of Time To Comply [[1219,1924,2201,1981][12][,,][Times New Roman]], agreeing to the compliance date of March 17, 2011. Compliance was not achieved and the daily fines began accruing on March 18, 2011. The As of January 18, 2018 the fines have accrued for 2498 days for a fine total of $1,281.550.00, and will continue to accrue at $500 per day until compliance is achieved. Additionally, per F.S. §162.07(2), if the local governing body prevails in prosecuting a case before the enforcement board, it shall be entitled to recover all costs incurred in prosecuting the case before the board and such costs may be included in the lien authorized under s. 162.09(3). To date these costs are $1,522.80 and continue to accrue until the case is closed. The code case remains open for non-compliance and failure to pay outstanding fines and costs. The County has exhausted all other mechanisms available to persuade the property owner to achieve compliance. The property is not homesteaded and there are no pending foreclosure actions at this time. Under the policy adopted in Resolution 057-2014 the available legal options in regard to the ìÛÙÑ×ÈìÕ ì 1. Initiate litigation against the property owner for injunction, foreclosure, money judgment and writ of execution; 2. Allow the liens to remain against the property owner, the subject property and any other property owned by the property owner; and/or 3. Reduce the amount of the fines. County staff recommends initiating litigation (option 1) against the property owner for injunction, foreclosure, money judgment and writ of execution.
