Approval of a resolution authorizing execution of a Quitclaim
Deed transferring land to the Florida Board of Trustees of the Internal Improvement Trust Fund to
remove a cloud on the title and allow the land to be managed by the Department's Division of
Recreation and Parks as part of the Bahia Honda State Park.
ITEM BACKGROUND:
Recently, a representative of the Florida Bureau of Public Land
Administration contacted the County Attorney to advise that as a result of a continual inventory
review and data cleanup, the bureau has determined that a minor error occurred in 1970, when the
County quitclaimed to the State certain land for Bahia Honda State Park. The original Deed
conveyed the land to the Board of Parks and Historic Memorials (see copy in agenda backup);
however, the Board of Parks and Historic Memorials did not exist in 1970. This has created a
potential cloud on the title.

of Trustees to clear the potential cloud on title. In researching the Deed, it was also discovered that
there was a mistake in the legal description which has now been corrected in addition to adding the
parcel identification and alternate key numbers to the Quitclaim Deed. Exhibit A to the Quitclaim
Deed provides the correct legal description of the subject land. The Bureau also provided a
photograph depicting the subject land which is included in the agenda backup.
A resolution approving an intergovernmental transfer of land is required by F.S. 125.38.
