Resolution 151-2018 o>� i 1 7 A V," RESOLUTION NO. 151. -2018 A RESOLUTION OF THE MONROE COUNTY BOARD. OF COUNTY COMMISSIONERS APPROVING THE RESERVATION OF SIXTEEN (16) AFFORDABLE MODERATE INCOME CATEGORY ROGO ALLOCATIONS FOR A PROPOSED EMPLOYEE DWELLING UNIT DEVELOPMENT ON CUDJOE KEY FOR HABITAT FOR HUMANITY OF KEY WEST AND LOWER FLORIDA KEYS ON PROPERTY DESCRIBED AS LOTS 8, 9, 10, & 11, BLOCK 8, CUTTHROAT HARBOR ESTATES, CUDJOE KEY, HAVING REAL ESTATE NUMBERS 00178350- 000000, 00178360- 000000, 00178370- 000000, AND 00178380- 000000, UNTIL JUNE 25, 2019. WHEREAS, the State of Florida and all local governments in the Florida Keys (each subject to Area of Critical State Concern mandates relating to housing affordability) recognize the need for affordable housing throughout the state and particularly in the Florida Keys where developable land for housing is extremely limited and expensive; and WHEREAS, the challenge of providing affordable housing opportunities in the Florida Keys is one requiring sensible and responsive use of residential unit allocations, including implementation of Tong -term preservation mechanisms; and WHEREAS, due consideration should be given to relevant factors such as the capacity for allocation recipients to promptly transform allocation awards /reservations into finished and occupied affordable /workforce housing units; and WHEREAS, the developers have legitimate needs for some assurance that allocations are in fact and will remain available and/or justified for a reasonable time so that follow- through on initial commitments will in fact be justified; and WHEREAS, the BOCC, on May 16, 2007, adopted Resolution 184 -2007 reserving sixty -nine (69) affordable housing allocations for four unspecified County projects; and WHEREAS, the BOCC, on February 20, 2008, adopted Resolution 047 -2008 reserving ten (10) more affordable housing allocations for unspecified County projects; and WHEREAS, the BOCC, on March 18, 2009, adopted Resolution 083 -2009 extending the reservation of ten (10) affordable housing allocations for unspecified County projects approved by Resolution 047 -2008 until August 20, 2010; and WHEREAS, the BOCC, on July 15, 2009, adopted Resolution 209 -2009, clarifying that one of the unspecified County projects for which reservations were made by Resolutions 184 -2007 and 083 -2009 was Lot 8, Block 8, Cutthroat Harbor Estates, Cudjoe Key, having real estate number 00178350- 000000, and continuing the reservation of sixteen (16) affordable housing allocations for Habitat for Humanity of the I Lower Keys (HHLK) for Lot 8, Block 8, Cutthroat Harbor Estates, Cudjoe Key, having real estate number 00178350- 000000 for a period of one (1) year; and WHEREAS, on September 2, 2009, the Planning Commission adopted resolution P45 -09 approving a minor conditional use permit for the development of sixteen (16) attached residential dwelling units, designated as employee housing, for property described as Lots 8, 9, 10, & 11, Block 8, Cutthroat Harbor Estates, Cudjoe Key, having real estate numbers 00178350- 000000, 00178360- 000000, 00178370- 000000, 00178380 - 000000; and WHEREAS, on April 11, 2018, the Planning Director approved an extension to the minor conditional use permit, whereby building permits for the project must be issued by June 25, 2019, and certificates of occupancy procured within two (2) years, six (6) months of the date of the issuance of the initial building permit, or the conditional use permit approval shall become null and void; and WHEREAS, HHLK entered into a 99 -year lease with Monroe County on November 17, 2015, for property described as Lots 8, 9, 10, & 11, Block 8, Cutthroat Harbor Estates, Cudjoe Key, having real estate numbers 00178350- 000000, 00178360- 000000, 00178370- 000000, 00178380 - 000000; and WHEREAS, on May 16, 2018, the BOCC approved an extension to the lease, according to which HHLK shall obtain permits for all affordable housing dwelling units by June 25, 2019, and shall receive certificates of occupancy for the sixteen (16) units no later than two (2) years, six (6) months from the date of each such permit's issuance; if the permits are not issued, the allocations will revert to the County; and WHEREAS, the reservation of affordable housing allocations for the anticipated project, does not exempt the project from applicable requirements for the Monroe County Land Development Regulations, Building Code and other regulatory requirements; and WHEREAS, HHLK shall obtain all required approvals from the Monroe County Planning & Environmental Resources Department for the project; and WHEREAS, the project mentioned above is still in process and the allocations are still required. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: The Monroe County Planning Department shall reserve sixteen (16) affordable ROGO allocations, consisting of sixteen (16) moderate income category allocations, for the Habitat for Humanity of Key West and Lower Florida Keys project on property described as Lots 8, 9, 10, & 11, Block 8, Cutthroat Harbor Estates, Cudjoe Key, having real estate numbers 00178350 - 000000, 00178360- 000000, 00178370 - 000000, 00178380- 000000, until June 25, 2019. Section 2: The developer must obtain the building permits for the sixteen (16) affordable employee housing units on or before June 25, 2019. Section 3: The developer shall comply with all Monroe County requirements, all applicable Building Code requirements, and requirements of any other oversight agencies. Section 4: The Planning and Building Department Staff is hereby authorized to process expeditiously permit related applications for the above referenced project when received. 2 of 3 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida at a regular meeting held on the 16th day of May, 2018.
