AGENDA ITEM WORDING: Approval of an Interlocal Agreement with the City of Key West
(City) for additional engineering design and permitting services for the 1st Street/Bertha Street
Roadway Improvement Project, whereby the City will reimburse the County in the design phase
amount of $20,495.00.
ITEM BACKGROUND:

The County has begun design for roadway and drainage improvements to 1 Street/Bertha Street
which is a County maintained road in the City of Key West (City). The County is responsible for the
road bed and drainage and the City is responsible for miscellaneous other items including but not
limited to sidewalks, traffic control devices and utilities operated by the City.
County engineering staff has coordinated with City engineering staff on improvements the City
would like to have designed into the project which are itemized in this Interlocal Agreement (ILA)
with the City, and Amendment 1 adding Task 6
for engineering design and permitting services for the project (companion Agenda Item 4850).
The project includes a sea level rise evaluation and is currently in the early stages of design and the
consultant is taking into consideration the high-water table, king tide issues, periodic flooding due to
sea level rise and other weather-related factors.
Per the terms of the ILA, in the future construction phase of the project, the City will reimburse the
County for 100% of the City scope of work and the proportionate cost of the mobilization and
maintenance of traffic of related bid items as defined in the construction schedule of values and, any
change orders requested and approved by the City.
PREVIOUS RELEVANT BOCC ACTION:
May 18, 2018 The BOCC approved a contract with EAC Consulting, Inc. for Engineering, Design,

Permitting and Post Construction Services for the 1 Street/Bertha Street (Key West) Roadway
Improvement Project in the maximum not to exceed amount of $451,126.16, including optional
services in the amount of $104,352.35.

October 18, 2017 The BOCC approved negotiations with EAC Consulting, Inc., the highest ranked
respondent to the RFQ for engineering design and permitting services for the project.
September 2014 - The BOCC approved the Road Paving and Rehabilitation Program in the 2015 to
2019 Capital Improvement Program.

FOR 1STREET/BERTHASTREET (KEY WEST) ROAD IMPROVEMENT PROJECT
THIS INTERLOCAL AGREEMENT is made and entered into as of this _____day of
January 2019, between Monroe County, a political subdivision of the State of Florida,
(hereinafter the COUNTY), and the City of Key West, a municipal corporation organized and
existing under the laws of the State of Florida, (hereinafter the CITY).

WHEREAS, 1Streetand Bertha StreetareCOUNTYmaintained roadswithin the
municipal limits of the CITY,and
WHEREAS,in accordance with Florida Statutes, theCOUNTYis responsible for the
maintenance of the roadway from curb face to curbface and associated drainageof the roadand
theCITYis responsible for the maintenance of physical improvements within the right of way
including but not limited to sidewalks, traffic control devices and utilities operated by the CITY,
and
WHEREAS, theCOUNTYis currently under contract in the engineering design and

permitting phase of the 1Street/Bertha Street Road Improvement Project(Project) with EAC
Consulting, Inc. (Consultant) and the CITYhas requested sidewalk and traffic control
improvements to be added to the COUNTYcontract
;and
WHEREAS, the CITYwill be responsible for reimbursing theCOUNTYfor the costs of
the additional Consultant Task 6 of (CITY scope of work)
and the portion of the construction costs associated with the CITY scope of work to be
determined during the COUNTYconstruction bid phase of the project;
NOW THEREFORE, in consideration of the mutual promises and conditions contained
herein, the parties agree as follows:
1.The COUNTYwill enter into Amendment 1(Task 6) to the contract with EAC Consulting,

Inc. (EAC) for Engineering Design and Permitting Services for 1Street/Bertha Street Roadway
Improvement Project, specifically for the requested CITYscope of work.
2. The Work will be performed in accordance with COUNTYand Florida Department of
Transportation(FDOT)standards.
3.The CITYwill reimburse the COUNTY100% of the CITY scope of work in the amount of
$20,495.00as defined in EAC Task 6 of Attachment A. The COUNTYwill submit a copy of

theAmendment 1 to the EAC Engineering Design and Permitting Services contract for1
Street/Bertha Street Roadway Improvement Project,to the CITYwith the request for
reimbursement and will include copies of all consultantpay applications, evidence of payment
to the consultant by the COUNTY.
