AGENDA ITEM WORDING: Authorization to advertise for sale County owned lots acquired for
density reduction to the highest and best bidder with the condition that such properties will be deed
restricted to prevent building a residential unit.
ITEM BACKGROUND: Commissioner Rice has been approached by neighbors of properties
acquired by the County for density reduction purposes. The neighboring property owners have
expressed an interested in acquiring those lots from the County.
The County has acquired approximately 20 lots through density reduction program on both Big Pine
and Duck Key. Staff is requesting authority to advertise all such lots. The solicitation will make
clear that the lots will be sold with a deed restriction that limits any purchaser or future owner from
constructing a residence on the lot. The deed restriction would permit the construction of accessory
structures that support a principal structure on an adjacent lot.
State law permits the Board to sell County owned property whenever the Board determines that it is
in the best interests of the County to do so. F.S. 125.35(1)(a). That statute requires that the County
solicit bids for each excess parcel which must be sold to the highest and best bidder. The Board
retains the discretion to rejects all bids. The statute requires that the solicitation of bids be published
in a newspaper of general circulation within the County at least once a week for two weeks. F.S.
125.35(1)(c).
