ITEM BACKGROUND: A building permit was applied for on 11/22/2005 and a ROGO application was applied for on 1/12/2006. The applicant applied for administrative relief on 7/6/2010 and is within the allowable time frame to be eligible for administrative relief under Section 138 -27 of the Monroe County Code. Staff recommends that administrative relief be awarded in the form of a purchase offer by the Monroe County Land Authority. The property is in Tier 3 -A and is not on the list for re- consideration of a tier designation. The property is on the FEMA Injunction List. As of Quarter 1 Year 19 this application's market rate ranking was #161 out of 178 applications in the Upper Keys subarea. If the owner does not accept the offer provided by the Land Authority, the property remains in ROGO. The application will continue to earn perseverance points pursuant to the vesting provision for applications in the ROGO system prior to the effective date of Ordinance 09 -2006. After the application has been in ROGO 5 years, it will begin earning 2 perseverance points per year for each year thereafter that the application remains in the ROGO system. The applicant may amend the ROGO application to increase points through land dedication or purchasing points. The vegetation on the site is characterized as tropical 7 hardwood hammock which is contiguous with hammock communities to the west and south. 8 According to GIS habitat data and field reviews of the parcel, the contiguous hammock 9 community is less than one acre, and as such would NOT qualify as Tier III -A under current Tier 10 criteria. 11 12 Relevant Board of County Commissioners (BOCC) Information: 13 June 16, 2010, the BOCC reviewed an Administrative Relief Application for Lot 3, Block 1, 14 Sunrise Point Revised, Key Largo, RE: 00484410.000000 and overturned staff recommendation 15 of a purchased offer by the Monroe County Land Authority. Therefore, the BOCC 16 recommended an allocation award for ROGO Application 05302669 to be taken out the next 17 available allocation quarter. The ROGO Application 05302669 was issued a building permit on 18 December 20, 2010. Since the issuance of the permit vegetation has been removed from the site. 19 This property is one lot away from the subject parcel. 20 21 22 III. LEGAL ELIGIBILITY AND OPTIONS 23 24 Eligibility for Administrative Relief Options: 25 Section 138 -27 of the Monroe County Land Development Regulations and Policy 101.6.1 of the 26 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received an 27 allocation award in the ROGO system may apply to the Board of County Commissioners for 28 Administrative Relief. The applicant is eligible for Administrative Relief having complied with 29 all requirements of the dwelling unit allocation system and having been considered in at least the 30 first sixteen consecutive quarterly allocation periods, and not having received an allocation 31 award. The application was timely submitted for administrative relief in the form of one (1) 32 ROGO allocation award and the applicant has not expressed a desire to sell the property to the 33 County. 34 35 Relief Options under Administrative Relief: 36 The remedies available to the Board of County Commissioners for Administrative Relief 37 pursuant to Section 138 -27 include: 38 39 a. Offer to purchase the property at its fair market value as its preferred action if the 40 property is located within: a) a designated Tier I area; b) a designated Tier II area 41 (Big Pine Key and No Name Key); c) a designated Tier III -A area (Special 42 Protection Area); or d) a designated Tier III area on a non - waterfront lot suitable 43 for affordable housing. 44 b. Suggest or provide such other relief as may be necessary and appropriate. 4 5 In the event purchase is recommended and the owner refuses the purchase offer, the 6 applicant may remain in the ROGO System and continue earning perseverance points 7 according to Monroe County Code Section 138 -28. 8 9 IV. RECOMMENDATION 10 11 It is recommended that the Board of County Commissioners find that the applicant has met the 12 criteria and qualifies for Administrative Relief. It is further recommended that a Resolution be 13 adopted that establishes this relief by an offer to purchase by the Monroe County Land 14 Authority. WHEREAS, William Riehl submitted an application for administrative relief under Sec. 138 -27 of the Monroe County Land Development Regulations; and WHEREAS, the Monroe County Board of County Commissioners makes the following findings of fact and conclusions of law: 1. The application for administrative relief from William Riehl is for Lot 5, Block 1, Revised Plat of Sunrise Point, Key Largo in Monroe County, Florida having RE# 00484430.000000. 2. The date of the ROGO application is 1/12/2006. 3. The ROGO allocation application has been in the ROGO system for at least four (4) consecutive years and qualifies for administrative relief under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive Plan. 4. Monroe County Code (MCC) Section 138 -27 provides a mechanism whereby an applicant who has not received an allocation award in ROGO may apply to the Board of County Commissioners for administrative relief. 5. The Board of County Commissioners (BOCC) has the authority to grant administrative relief under Section 138 -27(f) and may grant the applicant a building allocation, offer to purchase the property at fair market value, or provide such other relief as may be necessary and appropriate. 6. The applicant applied for administrative relief on 7/6/2010, under Section 138 -27 of the MCC and Policy 101.6.1 of the 2010 Comprehensive Plan. 7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be used for determining lands that are appropriate for acquisition and the criteria includes the environmental sensitivity of the vegetative habitat on the lot and the applicable Tier designation. This is a one page list. The subject property Is a Low Hammock Community with some disturbance. It is located on Snapper Lane. It is adjacent to a non - developed hammock on the west side,a highly disturbed property on the north with residual hammock and sapodillas and a developed property on the east side. Its southern center is invaded with some garden escape cactus. The edge on the road is invaded by the vine : ? ?? It has a solution hole at the northeast comer which has only a Brazilian pepper for vegetation. Two species, listed Regionally Important by Monroe County: Black Iron wood (Krugiodendron ferreum) and Ink wood (Exothea paniculata) and four species listed Endhngered by the State of Florida 1, Mahogany (Swietenia mahagoni), Soldier wood (Colubrina elliptica), Prince wood (Exostema caribaeum) and Prickly apple cactus (Cereus gracilis var. simpsonii) were found. The important native species have been taped in the field with a pink plastic tape with their name and number written on it. Please find enclosed their list and a map giving their approximate location in the hammock. Please, consult with the Monroe County Biologist for special requirements. Three woody species listed as pest invasive plants by the Florida Pest Plant Council were found: Lead tree (Leucaena leucocephala), Sapodilla (Meniikera sapote) Brazilian pepper (Schinus terebinthifolius). Tla pest invasive plants have been taped in the field with an orange plastic tape. Please, consult with the Monroe County Biologist for special requirements. " Pursuant to Section 9.5 -346, Mitigation standards and county environmental land management and restoration fund, the removal of any regionally important native plant species and all native trees with a diameter at breast height (DBH) of greater than four (4) inches shall require payment to the County Environmental Land Management and Restoration Fund in an amount sufficient to replace each removed plant or tree on a two to one (2:1) basis. The number, species, and sizes of trees and plants to be mitigated shall be identified in an existing conditions report approved by the county biologist. The subject property is a part of 1.3 acres of contiguous Tropical Hardwood Hammock. The elevation of the subject property is under 5 feet. Therefore a Low Hammock Habitat Analysis was conducted resulting in a Moderate Quality Low Hammock, However, the Monroe County Biologist, Mrs. Alex Score, will review this analysis and may incorporate her own opinion of the property into this reports thereby possibly affecting the final result. Please find a copy of Section 9.5 -343 giving the open space requirements. The .open space ratio for a moderate quality, low hammock is 0.60. 1. It contains two species, listed Regionally Important by Monroe County Black Iron wood (Krugiodendron ferreum) and Inkwood (Exothea paniculata) and four species. listed Endangered by the State of Florida Mahogany (Swietenia mahagoni), Milkbark (Drypetes diversifolia)), P ' ce wood (Exostema caribaeum) and Prickly apple cactus (Cereus gracilis var.. simpsonii). The later species grows in a patch of approximatively 25 feet by 5.O ; feet and occupies 18% of the parcel. It 'is located at 30 feet from the street.. The future construction plan might like to incorporate this valuable asset into its landscape: The important native species have, been taped in the field with a pink plastic tape with their name and number written on it. Please find enclosed their list and a map giving their approxirnatelocation in the hammock. Please, consult with the Monroe County Biologo(for:special requirements. This Low Hammock Community is mostly free of exotic or pest invasive plant species, except for a few patches of Garden Escape cactus (Opuntia spp.), a small amount of ground orchid (Oeceoclades maculata) and, listed as pest plant invasive category I by the Florida Exotic Pest Plant Council, (EPPC), traces of Oyster.;plants (Tradescantia spathacea) ). Two specimens of Brazilian peppers (Schinus terebinthifolius) (EPPC category I) are to be found at the northeastern corner of the property in a dissolution hole. This hammock contTns a small amount of human refuse and no significant ground disturbances. A 't►ative vine : Marine vine (Cissus trifoliata) is growing over a few canopy trees like a pest invasive plant species at the southern edge on Snapper Lane. According to the "Monroe County Endangered Animal Species Range Map ", there is no known endangered animal species documented for this area. There are a few mature Poisonwood trees (Metopium toxiferum) on the property. The fruits of these trees are a major food source for the White- crowned pigeon (Columba leucocephala). The fruits are available during summertime. As the survey was conducted in December, no pigeons could be reported. page two of three PS The Schauss Swallowtail Butterfly emerges in April and May. The females enter the hammock, searching for Wild Lime or Torchwood on which to lay their eggs. There is no Torchwood on the property, but a good amount of Wild Limes (Zanthoxyllum fagara) is present; again, the survey was done during the winter and could not determine the presence or absence of this endangered butterfly species. Only the Many -lined forest snail (DryM= multi lineatus) could be observed during this survey. The survey found no evidence to confirm the absence or presence of the federally threatened Stock Island Tree Snail.
