Resolution 409-2019 IV 6 7 RESOLUTION NO. 409 -2019 8 9 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY 10 COMMISSIONERS APPROVING THE EXTENSION OF A RESERVATION 11 FOR ONE (1) AFFORDABLE MODERATE INCOME CATEGORY ROGO 12 ALLOCATION FOR A PROPOSED EMPLOYEE DWELLING UNIT ON 13 CUDJOE KEY FOR MONROE COUNTY ON PROPERTY DESCRIBED AS 14 LOT 2, BLOCK 23, CUDJOE GARDENS EIGHTH ADDITION, CUDJOE 15 KEY, REAL ESTATE NUMBER 00174635-004500 UNTIL DECEMBER 31, 16 2020. 17 18 19 WHEREAS,the State of Florida and all local governments in the Florida Keys(each subject to Area 20 of Critical State Concern mandates relating to housing affordability) recognize the need for affordable 21 housing throughout the state and particularly in the Florida Keys where developable land for housing is 22 extremely limited and expensive; and 23 24 WHEREAS,the challenge of providing affordable housing opportunities in the Florida Keys is one 25 requiring sensible and responsive use of residential unit allocations, including implementation of long-term , 26 preservation mechanisms;and 27 28 WHEREAS,due consideration should be given to relevant factors such as the capacity for allocation 29 recipients to promptly transform allocation awards/reservations into finished and occupied 30 affordable/workforce housing units;and 31 32 WHEREAS,the developers have legitimate needs for some assurance that allocations are in fact and 33 will remain available and/or justified for a reasonable time so that follow-through on initial commitments 34 will in fact be justified;and 35 36 WHEREAS, the BOCC, on February 21, 2018, approved site for a proposed "Tiny Home"/Code 37 Compliant small modular unit for affordable housing;and 38 39 WHEREAS, the BOCC, on May 16, 2018, approved Project Management to issue a Request for 40 Proposals for up to four (4) "Tiny Houses" on parcels already owned by the County that will serve as 41 prototypes for redevelopment with eventual use as employee rental housing;and 42 43 WHEREAS, the BOCC, on June 20, 2018, approved the reservation of one moderate affordable 44 housing allocation award in Resolution 179-2018;and 45 46 WHEREAS, the reservation of affordable housing allocations for the anticipated project, does not 47 exempt the project from applicable requirements for the Monroe County Land Development Regulations, 48 Building Code and other regulatory requirements; and 49 50 WHEREAS, Monroe County shall obtain all required approvals from the Monroe County Planning 51 & Environmental Resources Department for the project; and 1 1 2 WHEREAS, Monroe County shall obtain permits for the affordable housing dwelling unit by 3 December 31,2020; if the permit is not issued, the allocations will revert to the County. 4 5 6 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 7 COMMISSIONERS OF MONROE COUNTY,FLORIDA: 8 9 Section 1: The Monroe County Planning Department shall extend the reservation for one (1) 10 affordable ROGO allocations, consisting of one (1) moderate income category allocations, for the Monroe 11 County project on Lot 2, Block 23, Cudjoe Gardens Eighth Addition,Cudjoe Key until December 31,2020. 12 13 Section 2: The developer must obtain the building permit for the one (1) affordable/employee 14 housing on or before December 3 I, 2020. 15 16 Section 3: The developer shall comply with all Monroe County requirements, all applicable 17 Building Code requirements,and any other oversight agencies. 18 19 Section 4: The Planning and Building Department Staff is hereby authorized to process 20 expeditiously permit related applications for the above referenced project when received. 2I 22 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida at a 23 regular meeting held on the 20th day of November,2019. 24 25 Mayor Heather Carruthers Yes • 26 Mayor Pro Tern Michelle Coldiron Yes 27 Commissioner Danny Kolhage Absent 28 Commissioner David Rice Yes 29 Commissioner Sylvia Murphy Yes 30 �Zr 31 , y =( BOARD OF COUNTY COMMISSIO ERS OF MONROE COUNTY, 32.
