36 WHEREAS,on April 3, 201r1 a cr:artarrrurruity rneeting, was held, as required by LDC Section
7 102-1:9(b)(3)> to di°�cuss the proposed Corriprehensive Plan and Land Development Code text
2 araaendnieurtsw and to provide, for public participation; and

30 WHEREAS,the Monroe C"a;aa.araty L eveloparaein Review Committee (DRC ) considered and
31 reviewed the proposed anieradment at a re ulaarly scheduled meeting held oil the 28"' day ol'May,
32 2019; and

34 WHEREAS, staff is r'ecorn aaenditig approval of the proposed amendments to the Monroe
3.5 County Land Development Code, Section 1.3 -' 4(a) to extend the time period of the Rate of
36 Growth Ordinance (ROGO) through 0 6; and
37
38 WHEREAS, the Monroe County Planning Coca-u-nission held a public hearing oil July 31,
39 2019, for review and recommendation on the proposed amendment; and.
40
41 WHEREAS, the Monroe County Planning Commission held a public heaariar , on July 31,
42 2019, for review and recommendation on the proposed amendment, and recommended approval
43 with changes through Resolution P3'3-19; and

I WHEREAS, at a regularly scheduled meeting held on the 22 nd day of January, 2020, the
2 Monroe County Board of County Commissioners held a public hearing,considered the staff report,
3 and provided for public cominent and public participation in accordance with the requirements of
4 state law and the procedures adopted for public participation in the planning process; and
5
6 WHEREAS, based upon the documentation. submitted and information provided in the
7 accompanying staff report, the BOCC makes the following Conclusions of Law:
8
9 1. The proposed amendment. is consistent with the Goals, Objectives and Policies of the
10 Monroe County Year 2030 Comprehensive Plan; and
11 2. The proposed amendment is consistent with the Principles for Guiding Development
12 for the Florida Keys Area of Critical State Concern, Sec. 380.0552(7), F.S.- and
13 3. The proposed amendment is consistent with Part 1.1 of Chapter 163, Florida Statute; and.
14 4. The proposed amendment is necessary due to consistency with the Comprehensive Plan
15 and the principles for guiding development, as required by Section 102-158 of the
16 Monroe County Code.
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
18 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

3 Monroe County will request a Rule change from the Administration Commission to
4 authorize an alternative allocation tirrieframe and rate,

8 Section 2. eveg l ilityb If any section, paragraph, subdivision, clause, sentence or
9 provision of this ordinance shall be adjudged by any court of competent jurisdiction to be invalid,
10 such judgment shall not affect, impair, invalidate, or nullify the remainder of this ordinance, but
11 the effect thereof shall be confined to the section, paragraph, subdivision, clause, sentence, or
12 provision immediately involved in the controversy in which such judgment or decree shall be
13 rendered.

15 Section 3. Conflicting Provisions. All ordinances or parts of ordinances in conflict with
16 this ordinance are hereby repealed to the extent of said conflict.

18 Section 4. Transmittal. This ordinance shall be transmitted to the Florida State Land
19 Planning Agency as required by F.S. 380.05 (11) and F.S. 380.0552(9).

21, Section 5. Filigg. "Phis ordinance shall be filed in the Office of the Secretary of the State
22 of Florida but shall not become effective pursuant to Section 9 until a final order is issued according
23 to F.S. 380.05(6) by the Florida State Land Planning Agency or Administration Commission
24 approving the ordinance, and if the final order is challenged, until the challenge to the order is
25 resolved pursuant to F.S. Chapter 120.

27 Section 6. Inclusion in the Monroe C2qp1y_L2dgthe provisions of this Ordinance shall
28 be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an
29 addition to amendment thereto, and shall be appropriately renumbered to conform to the uniform
30 marking system of the Code.

32 Section 7. Effective Date. This ordinance shall become effective contingent Oil
33 effectiveness of the corresponding amendrilents to the Monroe County Year 2030 Comprehensive
34 Plan and as provided by law and stated above.

FINAL ORDER
APPROVING MONROE COUNTY ORDINANCE NO.006-2020
The Department of Economic Opportunity("Department")hereby issues its Final Order,
pursuant to sections 380.05(6)and 380.0552(9), Florida Statutes, approving land development
regulations adopted by Monroe County, Florida, Ordinance No. 006-2020(the"Ordinance").
FINDINGS OF FACT
1. The Florida Keys Area is designated by Section 380.0552,Florida Statutes, as an
area of critical state concern. Monroe county is a local government within the Florida Keys Area.
2. The Ordinance was adopted by Monroe County on January 22, 2020,and
rendered to the Department on March 13,2020.
3. The Ordinance amends Section 138-24(a),Residential ROGO Allocations,of
Monroe County's Land Development Code to ensure consistency with the Comprehensive Plan
by extending the ROGO allocation timeframe until July 12,2026.
CONCLUSIONS OF LAW
4. The Department is required to approve or reject land development regulations that
are adopted by any local government in an area of critical state concern. See §§ 380.05(6)and
380.0552(9),Fla Stat.

5. "Land development regulations"include local zoning, subdivision,building, and
other regulations controlling the development of land. § 380.031(8),Fla. Stat. The regulations
adopted by the Ordinance are land development regulations.
6. The Ordinance is consistent with the Monroe County Comprehensive Plan
generally, as required by section 163.3177(1), Florida Statutes, and specifically, with Policy
101.3.2
7. All land development regulations enacted, amended, or rescinded within an area
of critical state concern must be consistent with the Principles for Guiding Development for that
area. § 380.05(6) and 380.0552(9), Fla Stat. The Principles for Guiding Development for the
Florida Keys Area of Critical State Concern are set forth in Section 380.0552(7),Florida
Statutes.
8. The Ordinance is consistent with the Principles for Guiding Development as a
whole, and specifically complies with the following:
(a) Strengthening local government capabilities for managing land use and
development so that local government is able to achieve these objectives without
continuing the area of critical state concern designation.
(d) Fnsuring the maximum well-being of the Florida Keys and its citizens through
sound economic development.
(n) Protecting the public health, safety, and welfare of the citizens of the Florida Keys
and maintain the Florida Keys as a unique Florida resource.

WHEREFORE, IT IS ORDERED that the Department finds that Monroe county
Ordinance No. 006-2020 is consistent with the Monroe County Comprehensive Plan and
Principles for Guiding Development for the Florida Keys Area of Critical State Concern and is
hereby APPROVED.
This Order becomes effective 21 days after publication in the Florida Administrative
Register,unless a petition is timely filed as described in the Notice of Administrative Rights
below.
