Resolution 029-2020 Y 2 3 4 MONROE COUNTY, FLORIDA IDA BOARD L COUNTY COMMISSIONERS RESOLUTION NO. 029 - 2020 7 8 A RESOLUTIONY THE MONROE COUNTY BOARD OF 9 COUNTY COMMISSIONERS CONFIRMING THE 10 ADMINISTRATIVE BOIJND Y INTERPRETATION OF 11 THE SENIOR DIRECTOR OF PLANNING AND 12 ENVIRONMENTAL RESOURCES IN LAND USE DISTRICT 13 MAP AND FUTURE USE (FLU ) BOUNDARY 1.4 DETERMINATION REGARDING PORTION OF LAND IN 15 SECTIONS 26, TOWNSHIP 62, AND RANGE 38, 16 TAVERNIER, MONROE COUNTY,', FLORIDA, HAVING 17 PARCEL IDENTIFICATION NUMBERS 00479 01-0001.00, 1.8 004790 -0001200 & 0047901-00220 q 19 20 WHEREAS, on September 19, 2019, the Monroe County Planning and Environmental 21 Resources Department received a request from the ,Association of Ocean Pointe Unit 22 Owners, Inc, (applicant) for a boundary determination for property located at 500 Burton 23 Dr., Tavernier, to change a portion of the; property's Land Use DistrictMal? (L1.1D) 24 designation fi-om Native Area (NA) to Suburban Residential (SR) and Future Land Use 25 Map (F'L.UM) designation of the Residential Conservation (RC) to Residentiaal. Low (RL.),. 26 thereby designating the portion of the property with buildings all as Sly and. RL 27 designations; and. 28 29 WHEREAS, the subject property is a portion of land in Sections 26, Township 62, and 30 Mange 38, Tavernier, Monroe County, Florida; and 31. 32 WHEREAS, pursuant to Monroe county Land Development.Code Section 102-21(b)(2)h. 33 it is the authority of the Planning Director to render interpretations of the Comprehensive 34 Flan, the Land Development Code, or the boundaries of the official Land Use (Zoning) 35 District Map and Future Land. Use Map; and 3 37 WHEREAS,pursuant to MCC §10 -158(e),typographical or drafting errors: amendments 38 to the text to correct typographical or drafting errors may be adopted by the BOCC without 39 posted notice or public hearing at any regular meeting; and 40 41. WHEREAS, pursuant to MCC §102-158(e)r notice of such amendments shall be 42 transmitted to the State Land Planning agency within 30 days; and 43 44 NCI's', THEREFORE, BE IT RESOLVED BY THE MO CIE COUNTY T O D 45 OF COUNTY TY COMMISSIONERS THAT: 46 R solualc:rn No. _029-20120 Pa zge 1 of 2 File 201.9-175 • • 47 The action by Emily Schemper; Senior Director of Planning & Environmental Resources, 48 recommending correction of the land use district boundary and future land use district 49 boundary is hereby found to be in conformance with the standards set forth in the Monroe 50 County Code and Comprehensive Plan and is therefore approved. 51 52 Section 1. The aforementioned, described area in the first whereas clause shall be 53 designated as Suburban Residential (SR) on the official Land Use District Map (attached 54 hereto as Exhibit 1.). Others areas of the subject property shall maintain their designation 55 as shown on the official Land Use District Map (also known as the Craig_Ma_p). 56 57 Section 2. The aforementioned, described area in the first whereas clause shall be 58 designated as Residential Low (RL) on the future land use map (attached hereto as Exhibit 59 2). Others areas of the subject property shall maintain their designation as shown on the 60 future land.use map. 61 62 Section 3. The above conclusions of law are predicated upon the findings of fact and 63 conclusions of law outlined in the staff recommendation, which this Board hereby adopts 64 as its own. 65 66 Section 4. The Clerk of the Board is hereby directed to forward a certified copy of this 67 Resolution to the Monroe County Growth Management Division. 68 69 Section 5.
