Resolution 031-2020 cop ((p .:(4.-)"4.4.4 1 2 RESOLUTION NO. 031 -2020 3 4 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY 5 COMMISSIONERS APPROVING THE RESERVATION OF TWO 6 HUNDRED-EIGHTY (280) AFFORDABLE HOUSING ALLOCATIONS 7 CONSISTING OF SEVENTY (70) LOW INCOME, NINETY-EIGHT (98) 8 MEDIAN AND ONE HUNDRED TWELVE (112) MODERATE INCOME 9 CATEGORY ROGO ALLOCATIONS FOR A PROPOSED AFFORDABLE 10 DWELLING UNIT DEVELOPMENT ON SUGARLOAF KEY FOR MONROE 11 COUNTY ON PROPERTY DESCRIBED AS LOTS 1-10,AND 16-20, BLOCK 12 34, MALONEY SUBDIVISION, STOCK ISLAND HAVING REAL ESTATE 13 NUMBER 00124560-000000; LOTS 1-2 AND 18-20, BLOCK 33, MALONEY 14 SUBDIVISION, STOCK ISLAND HAVING REAL ESTATE NUMBER 15 00124550-000000; AND LOTS 1-7 AND 11-21, BLOCK 32, MALONEY 16 SUBDIVISION, STOCK ISLAND HAVING REAL ESTATE NUMBER 17 00124540-000000(APPROXIMATE MILE MARKER 5)UNTIL JANUARY 22, 18 2025 FOR BUILDING PERMIT ISSUANCE. 19 20 WHEREAS,the State of Florida and all local governments in the Florida Keys(each subject to Area 21 of Critical State Concern mandates relating to housing affordability)recognize the need for affordable housing 22 throughout the state and particularly in the Florida Keys where developable land for housing is extremely 23 limited and expensive;and 24 25 WHEREAS,the challenge of providing affordable housing opportunities in the Florida Keys is one 26 requiring sensible and responsive use of residential unit allocations, including implementation of long-term 27 preservation mechanisms;and 28 29 WHEREAS,due consideration should be given to relevant factors such as the capacity for allocation 30 recipients to promptly transform allocation awards/reservations into finished and occupied 31 affordable/workforce housing units; and 32 33 WHEREAS,the developers have legitimate needs for some assurance that allocations are in fact and 34 will remain available and/or justified for a reasonable time so that follow-through on initial commitments will 35 in fact be justified;and 36 37 WHEREAS,in accordance with Section 138-24(b)(4) of the Monroe County Land Development 38 Code allows the BOCC to authorize reservations for "Specific affordable or employee housing programs 39 sponsored by the county pursuant to procedures and guidelines as may be established from time to time by 40 the BOCC,"and 41 42 WHEREAS,the reservation of affordable housing allocations for the anticipated project,does not 43 exempt the project from applicable requirements for the Monroe County Land Development Regulations, 44 Building Code and other regulatory requirements;and 45 1 1 WHEREAS,Wreckers Cay Apartments at Stock Island LLC shall obtain all required approvals 2 from the Monroe County Planning&Environmental Resources Department for the project;and 3 4 WHEREAS, Wreckers Cay Apartments at Stock Island LLC shall obtain permits for the 5 affordable housing dwelling units by January 22, 2025; if the permit is not issued, the allocations will 6 revert to the County; 7 8 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 9 COMMISSIONERS OF MONROE COUNTY,FLORIDA: 10 11 Section 1: The foregoing recitals are true and correct,and are hereby incorporated as if fully set 12 forth herein. 13 14 Section 2: The Monroe County-Planning Department shall reserve two hundred-eighty (280) 15 affordable ROGO allocations, consisting of seventy(70) low income, ninety-eight(98) median and one 16 hundred twelve(112)moderate income category allocations,for the Monroe County project on Lots 1-10 17 and 16-20, Block 34, Maloney Subdivision, Stock Island having real estate number 00124560- 18 000000; Lots 1-2 and 18-20,Block 33,Maloney Subdivision,Stock Island having real estate number 19 00124550-000000;and Lots 1-7 and 11-21,Block 32,Maloney Subdivision,Stock Island having real 20 estate number 00124540-000000 until January 22, 2025. 21 22 Section 3: The developer must obtain the building permits for the affordable/employee housing 23 units on or before January 22,2025. 24 25 Section 4: The developer shall comply with all Monroe County requirements, all applicable 26 Building Code requirements,and any other oversight agencies. 27 28 Section 5: The Planning and Building Department Staff is hereby authorized to process 29 expeditiously permit related applications for the above referenced project when received. 30 31 0 . o PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,Florida at a 32 C gulir meeting` eld on the 22nd day of January,2020., 33 F c "- 34 t > Mayor Heather Carruthers Yes 35 Mayor Pro Tem Michelle Coldiron Yes 36 g =' Commissioner Craig Cates Yes 37 'y' Commissioner David Rice Yes 38 Commissioner Sylvia Murphy Yes _ o 40 BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA BY A 43f � t Mayor He s' y:T " . # u� 4h mil 44�� t r d vAi ST i V MADOK,CLERK 4 i pN COUNTY A M 7n 48 ''-DEPUTE-CLERK T Dote c:Q '' l 2
