10 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY
11 COMMISSIONERS WAIVING APPROXIMATELY$28,856 IN BUILDING
12 PERMIT FEES FOR A TOTAL OF EIGHT(8)AFFORDABLE EMPLOYEE
13 HOUSING DWELLING UNITS COMPRISED OF THREE (3) LOW
14 INCOME AND FIVE (5) MODERATE INCOME, OR BELOW, TO BE
15 CONSTRUCTED ON A PARCEL LOCATED AT 5176 SUNCREST ROAD,
16 ON STOCK ISLAND HAVING REAL ESTATE (RE) NUMBER 00132680-

19 WHEREAS,on November 18,2009 the Monroe County Board of County Commissioners
20 ("Board") passed and adopted Ordinance 036-2009, allowing building permit fee waivers for
21 entities building low income housing leveraging state or federal funds, or affordable housing as
22 defined by state statutes; and
23 WHEREAS, on February 10, 2010, the Board passed and adopted Ordinance 004-2010,
24 allowing waivers for housing for households up to 120% of median income in Monroe County.
25 Housing exceeding 120% may also apply for a waiver if the specific project for development is
26 being subsidized with or is leveraging state or federal funding; and
27 WHEREAS, on January 28, 2020 Smith Hawks, PL, Agent for the Applicant Mobile
28 Homes Holdings Suncrest, LLC submitted the Application for Building Permit Fee Waiver. The
29 legislative intent of this Resolution is that the instant waiver shall apply to the building permit
30 applicant of record; and
31 WHEREAS, Monroe County Code Section 6-108(e) allows the Board approval for
32 waivers of building permit fees for affordable housing which have a Development Order in effect.
33 The Applicant of Record is requesting building permit fee waivers totaling approximately$28,856
34 to construct eight(8) affordable two bedroom,two bathroom housing units at 5176 Suncrest Road
35 on Stock Island through two four-unit multi-family buildings comprised of three (3) low income
36 and five(5)moderate income units.

38 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
39 COMMISSIONERS OF MONROE COUNTY,FLORIDA,THAT:
40 The foregoing recitals are true and correct and are hereby indorporated as if fully stated
41 herein; and
42 Building permit fees are waived pursuant to Monroe County Code Section 6-108(e) for
43 each of the eight(8)affordable housing units described herein with the condition that evidence of
44 an Affordable Housing Deed Restriction accepted and/or approved by both the Senior Director of
45 Planning & Environmental Services and the Office of the County Attorney and recorded in the
46 Public Records of Monroe County, Florida shall be provided to the Building Department.
47 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
48 Florida,at a regular meeting held on the 15 th day of April ,2020.
