ITEM BACKGROUND: On January 16, 2014, there was a discussion of seeking mobile vendors at Higgs Beach. On January 31, 2014, the BOCC approved to advertise for mobile vendors at Higgs Beach. The 2014 Request for Proposals (RFP) was for one (1) food and one (1) non-food retail mobile concessions, in addition to the pre-existing Salute Restaurant and Tropical Watersports mobile concession. There were two (2) mobile food respondents and no non-food respondents that submitted proposals in response to the RFP. In response to the 2014 RFP, the BOCC approved a Lease Agreement for a Higgs Beach Concesssion for a mobile food vendor with Pam Uslander on December 10, 2014, as Lessee. The initial term was for one year with an expiration of December 31, 2015. The Lease could be renewed for two (2) additional two-year terms. On January 20, 2016, the County extended the original Lease for six (6) months to evaluate the Lessee's performance before entering into an additional two-year term. On May 18, 2016, the BOCC approved the first of the two optional two-year terms. A second Lease renewal on May 16, 2018, exercised the last optional two-year term, which expired on June 30, 2020. On June 17, 2020, the BOCC approved a Third Amendment to the Lease, which extended the term on a month-to-month basis, not to exceed six months, in order to allow for a new RFP to be published and a contract awarded. This is a request for approval to advertise a new RFP to seek proposals for one (1) food and one (1) non-food mobile concessions at Higgs Beach, since there are no additional extensions available on the current concession Lease. It has been determined that it is an asset to provide mobile concessions at the Beach for locals and tourists to enjoy additional amenities during their beach visits. PREVIOUS RELEVANT BOCC ACTION: January 16, 2014 BOCC has a discussion on utilizing mobile vendors at Higgs Beach. January 31, 2014 BOCC approved to advertise for mobile vendors at Higgs Beach. Packet Pg.458 C.11 December 10, 2014 BOCC approved a Lease Agreement for a mobile food concession with Pam Uslander. January 20, 2016 BOCC extended the original term of the Uslander Lease Agreement for six months. May 18, 2016 BOCC approved the first two-year renewal option under the Uslander Lease. May 16, 2018 BOCC approved the Second Lease Agreement Renewal to extend the term of the Uslander Lease. September 2018 Monroe County issued an RFP soliciting proposals for two (2) non-food retail mobile concessions in the Higgs Beach Park. There was one non- food retail mobile concession respondent. October 17, 2018 Tropical Watersports, LLC was awarded a new Lease Agreement in response to the RFP for a non-food retail mobile concession. July 17, 2019 BOCC approved a Lease Assignment, Assumption, and Consent for Tropical Watersports, LLC to assign its rights, interests, and obligations under the Lease Agreement to Salute Watersports, LLC. June 17, 2020 BOCC approved a Third Amendment to the Uslander Lease, which extended the term on a month-to-month basis not to exceed six (6) months pending the issuance of a RFP and award of a contract.
