ITEM BACKGROUND: CE17030036: This property has been the subject of a code compliance case for violations concerning vacation rental and advertising. The fines total $10,000.00 as of March 10, 2020 and will continue to accrue costs until the case is closed. A hearing was scheduled for May 25, 2017; however, the matter was continued five times and a hearing was held on February 22, 2018. The Special Magistrate found the property in violation and imposed a $10,000.00 one-time fine payable in 30 days, plus administrative costs. The case was also deemed compliant on this date. No one appeared on behalf of the property owner. The County's lien was then recorded on April 10, 2018. On June 27, 2019, a hearing was held and property owner was present. Special Magistrate granted the County's motion to proceed with collection actions. The code case is compliant; however, remains open for failure to pay outstanding fines and costs. The Monroe County Property Appraiser's Fair Market Value of the property is $341,051.00. There is a balloon mortgage recorded against the property for $341,842.67 with a final payment due on April 1, 2021. Although not a homestead at the time of the violations, the property is now a homestead property and there are no pending foreclosures actions at this time. There are no other liens recorded against the property. Under the policy adopted in Resolution 057-2014 the available legal options in regard to the County's lien on this property are: 1. Initiate litigation against the property owner for money judgment; 2. Allow the liens to remain against the property owner, the subject property and any other property owned by the property owner; and/or 3. Reduce the amount of the fines. With a balloon mortgage scheduled to come due less than a year from now, the County can expect its lien to be satisfied as a result of the refinancing without having to expend further resources. PREVIOUS RELEVANT BOCC ACTION: Approval of Resolution No. 057-2014 on March 19, 2014 adopting "ATTACHMENT A" as Procedure to be used after a Final Order has been rendered by the Code Compliance Special Magistrate to initiate injunctive relief for non-compliant properties, foreclosure and/or money judgment actions for collection of unpaid fines and/or costs from a property owner.
