ITEM BACKGROUND: CE17050007: This property has been the subject of a code compliance case for a violation concerning failure to complete mandatory sewer connection. The fines total $62,700.00 as of May 27, 2020 and costs will continue to accrue until case is closed. A hearing was held on June 29, 2017 and no one appeared on behalf of the property owner. The Special Magistrate found the property in violation and provided a compliance date of September 21, 2017. If the property was not compliant by the specified date, a fine of$100.00 per day would begin to accrue until compliant. The County's lien was recorded on December 11, 2017. A subsequent hearing was held on February 28, 2019 and an attorney appeared on behalf of the property owner. The Special Magistrate found the property was still in violation and granted the County's motion to proceed with collections. The property came into compliance on June 11, 2019 and on July 3, 2019, the County relayed an offer to the property owner's attorney to settle the fines and costs and the offer was accepted on July 9, 2019. On September 7, 2019, attorney for property owner was advised by the County that the offer had expired due to non-payment. The code case is compliant; however, remains open for failure to pay outstanding fines and costs. The property is not homesteaded and there are no pending foreclosures actions at this time. Under the policy adopted in Resolution 057-2014 the available legal options in regard to the County's lien on this property are: 1. Initiate litigation against the property owner for foreclosure, money judgment and writ of execution; 2.
