ITEM BACKGROUND: Florida law directs each local government participating in the State Housing Initiatives Partnership (SHIP)Program to appoint an affordable housing committee. F.S. 420.9076. The BOCC adopted 2-700 of the County Code to establish County's Affordable Housing Committee (AHAC). Prior to 2016, F.S. 420.9076 required that such appointments be made by resolution. That formality was removed from the statute in 2016. Unfortunately, when the Board adopted Ordinance 004-2021 to conform M.C.C. 2-700 to an updated version of F.S. 420.9076, the formality of making appointments by resolution was retained. The proposed ordinance would remove the formality of requiring appointments to the AHAC be made by resolution. The Board appoints citizens to more than twenty advisory committees without the formality of an appointing resolution. The proposed ordinance would eliminate unnecessary staff work and conform the AHAC appointment practice to that of other advisory committees. WHEREAS, the Board of County Commissioners of Monroe County, Florida (hereinafter "Board") enacted Ordinance 014-2008, 014-2015; and 004-2021 to implement W the direction of F.S. 420.9076 to establish an Affordable Housing Advisory Committee (AHAC); and s �t WHEREAS, when F.S. 420.9076 was first enacted, it required that appointments be made by resolution; and WHEREAS, when F.S. 420.9076 was updated in 2016 through the enactment of 0 chapter 2016-210,the requirement that appointments be made by resolution was stricken from the statute; and 0 CD WHEREAS, when the Board adopted ordinance 004-2021 to conform Section 2-700 of the County Code to new requirements in F.S. 420.9076, the requirement that appointments 'a be made by resolution was retained; and WHEREAS, the Board appoints members to several other advisory committees without adopting a resolution for each appointment; and 0 CD WHEREAS, the Board finds that retaining the formality of requiring a resolution for each appointment to the AHAC serves no meaningful purpose and, in fact, results in the CD unnecessary expenditure of staff time. 9 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Page 1 of 2 Packet Pg. 2113 P.9.ai (Language removed from 2-700(b) appears as str;, ke.p thrG4g ) SECTION 1. Section 2-700(b) of the Monroe County Code is hereby amended to read as 0 follows: 2 The affordable housing advisory committee shall consist of no less than eight but not more than 11 members who shall be appointed by the BOCC c 0 SECTION 2. Severability. If any section, subsection, sentence, clause, or provision of this ordinance is held by a court of competent jurisdiction to be invalid, the remainder of this ordinance shall not be affected by such invalidity. SECTION 3. Repealer and Conflict. All County ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. SECTION 4. Effective Date. This Ordinance shall take immediate effect upon adoption and shall be filed with the Department of State. E a� SECTION 5. Codification. The Board directs the Clerk to send this ordinance to the Municipal Code for publication in the Monroe County Code of Ordinances.
