ITEM BACKGROUND: EDU allocations for the 2007 non -ad valorem tax roll were based on the PC Code classifications on record with the Monroe County Property Appraiser. Property owners who appealed original EDU allocations were advised to request that the Property Appraiser perform an inspection to determine whether a building was a single or multi -family residence. Approval is also sought to correct the EDU allocation for a property that was redeveloped during the tax roll development such that the EDU allocation is consistent with the residential units exempt under the Rate of Growth Ordinance (ROGO). PREVIOUS RELEVANT BOCC ACTION: On September 10, 2007 the Monroe County Board of County Commissioners adopted Resolution 302-2007, known as the "Final Assessment Resolution" relating to the provision of wastewater capacity; imposing annual wastewater assessments; approving the non -ad valorem assessment roll; providing for collection of the wastewater assessments; and providing an effective date. As stated in Section 3 of Resolution 302-2007, "System Development Fee" means that portion of the capital cost of the wastewater system being assessed to each owner of a Tax Parcel up to a maximum of $4,500 per Equivalent Dwelling Unit (EDU). The number of EDUs for residential properties will be the number of residential units for that Tax Parcel as determined by the Property Appraiser at the time of the adoption of the resolution." On July 18, 2007 the BOCC adopted Resolution 264-2007 relating to the provision of wastewater service to properties; describing the system development fee, collection costs and the other terms and conditions of the non -ad valorem annual wastewater assessments; establishing the amount and term of the annual wastewater assessment for each parcel of property to be assessed; directing preparation of the initial non -ad valorem assessment roll; establishing a public hearing to consider imposition of the proposed wastewater assessments and the method of their collection; directing the provision of notice in connection therewith; and providing an effective date. The PC Code is a classification which is used to determine the number of equivalent dwelling units (EDUs). Single family residences were assessed for one (1) EDU, duplexes for two (2) EDUs and multi -family residences according to the number of living units. A PC Code of "00" designates a vacant parcel; PC Code "01" designates single family residence; "02" designates mobile home; "03" designates multi family (10 units or more). A Master PC Code List Classification is attached for reference. After the Final Assessment Roll was adopted, a handful of calls were received from property owners indicating that the assessment did not accurately reflect the residential use of their property. Staff explained to callers that the tax roll was developed based on the PC Code on file with the Property Appraiser's office and directed to file a Wastewater EDU Appeals Form with the Florida Keys Aqueduct Authority (FKAA). The Wastewater Department recommends tax roll corrections for the parcel numbers listed below based on the FKAAs approval of the appeal to adjust the EDU allocation from the original EDUs of two (2) to revised EDUs of one (1).
