AGENDA ITEM WORDING:
Discussion and direction for establishing a new county process for road closures.
ITEM BACKGROUND:
At a previous meeting, the BOCC asked county staff within the Growth Management Division, the Public Works
Division and Emergency Services to work together to create a process to close or open ends of county roads. Some issues
have been raised by surrounding property owners after road closures in the past. After meeting, staff developed a
proposed process:
1) Application for road closure by interested party
2) Coordinate with other county departments, affected agencies and utility providers
3) Notify surrounding property owners within 300' or 500' of the proposed closure and the date of the BOCC meeting
or hearing
4) Advertise for BOCC as public meeting or hearing and take public input
5) BOCC hears request and motions to approve, approve with conditions or deny
If the BOCC directs, staff will prepare an ordinance to amend the Monroe County Code to codify this process.
PREVIOUS RELEVANT BOCC ACTION:
The BOCC has reviewed proposed road closures in the past. Four examples of the BOCC working with the Public Works
Division to close roads are:
• October 17, 2007: A public hearing was held to consider a request was received from the County's Land Steward,
Beth Bergh, to close Barataria Road to vehicular access due to illegal dumping and misuse of the property. All the
platted lots on the east side of the road are currently in public ownership (either Monroe County or the State of
Florida) and the platted lots on the west side of Barataria Road are submerged lands that are privately owned.
• October 21, 2009: A public hearing was held to consider a request was received from the County's Land Steward,
Beth Bergh, to close a portion of Richard Road to vehicular access due to illegal dumping and misuse of the property.
• February 17, 2010: A public hearing was held to consider a request was received from the County's Land Steward,
Beth Bergh, to close a portion of Mariposa Road to vehicular access due to illegal dumping and misuse of the
property.
• May 19, 2010: A public hearing was held to consider adoption of a resolution closing the extension of Kay Drive,
north of the intersection of Kay Drive and Avenue D, from sunset to sunrise, in Key Largo. There had been
complaints about misuse occurring at the extension of the Kay Drive right of way. Closing the area from sunset to
sunrise and posting signage to this effect will assist the Sheriff's Office in helping to end or diminish misuse of this
area. The request was approved, as memorialized in Resolution 146-2010.
