Approval of a Resolution authorizing the Monroe County Health Department to establish
environmental health service fees for services offered as set forth in Exhibit A attached to and made a
part of the resolution
ITEM BACKGROUND:
F.S. 154.01(2) requires Counties to establish and maintain full-time county health departments to
provide environmental health, communicable disease control and primary care services through
contract with the Florida Department of Health. Florida Statutes further provide that environmental
health fees should be assessed in an amount sufficient to recover the costs of providing the service.
The County has the authority to set and assess fees for the benefit of the MCHD under its home rile
powers and F.S. 125.01 (1). The MCHD is requesting authorization to increase environmental health
fees for services offered at the MCHD.
PREVIOUS RELEVANT BOCC ACTION:
9/17/10 Board requested the Monroe County Health Department to review its Environmental Health
Service fees for potential increases.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA
AUTHORIZING THE MONROE COUNTY HEALTH
DEPARTMENT TO ESTABLISH AND COLLECT FEES
FOR ENVIRONMENTAL HEALTH SERVICES, AS SET
FORTH IN EXHIBIT "A" ATTACHED HERETO AND
MADE PART OF THIS RESOLUTION
WHEREAS, Florida Statute Section 154.01 (2) requires counties to
establish and maintain full-time County Health Departments to provide
environmental health, communicable disease control, and primary care services;
and
WHEREAS, the Monroe County Health Department is authorized to
establish and collect reasonable fees in connection with services performed by
said County Health Department, by virtue of Resolution adopted by the Board of
County Commissioners in accordance with Chapter 154, Florida Statutes, as
amended, and other applicable statutes and laws of the State of Florida; and
WHEREAS, Florida Statutes, including those relating to Environmental
Health services (F.S. 381.0072 (4)(a); 381.0066(1); and 514.033(1)), provide that
the fees assessed be in an amount sufficient to meet the cost of carrying out the
services; and
WHEREAS, the Monroe County Health Department reviewed the fees
collected by its Environmental Health Program, and determined that in order to
assist in defraying the cost of providing the services required, said fees should be
set in accordance with the Fee Schedule made a part hereof by reference; and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, has authority, under its home rule powers and pursuant to Florida Statute
Section 125.01(1), to pass a fee resolution for the benefit of the Monroe County
Health Department, and has reviewed the recommendation of the Monroe
County Health Department and approved the Environmental Health Fee
Schedule attached hereto and marked as Exhibit "A" and made a part of this
Resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that:
1. The Monroe County Health Department shall collect fees for
Environmental Health Services as specified in Exhibit `A" attached hereto
and made a part of this Resolution.
2. The Monroe County Health Department is solely responsible for ensuring
effective notice in provided to the general public and other impacted
agencies and organizations of the specific fee increases.
3. The Monroe County Health Department is solely responsible for ensuring
the County's compliance with all financial and transitional rules and
regulations, and any other factors that may be impacted by the service fee
increases at all levels, local, state, and federal.
4. Any prior resolution, ordinance, or contract setting forth Environmental
Health service fees inconsistent herewith is hereby repealed.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at a regular meeting held on the day of
