AGENDA ITEM WORDING: Approval to reject single bid and re-advertise for the Florida Keys
Overseas Heritage Trail (FKOHT) Connection at Cudjoe Gardens project. FDOT requires rebidding
if the construction is funded by a Florida Department of Transportation Local Agency Program
(LAP) agreement.
ITEM BACKGROUND:
The construction project consists of an approximately 900 ft asphalt shared use path from Drost
Drive connecting to the US1 crosswalk to the Florida Keys Overseas Heritage Trail (FKOHT) which
is across the street. The project was advertised on January 19, 2022, and one bid was received on
March 1, 2022, with Charley Toppino & Sons, Inc. being the single bidder. FDOT LAP funding
requires that the local agency submit a request for exception to award to a single bidder.Staff
submitted substantial documentation on March 15 and March 29, 2022, to support the following four
exception criteria:

Monroe County Purchasing Policy Chapter 3 - Competitive Solicitation Process - Rejection of
Responses.D.1. The BOCC shall have the authority to reject any and all responses to a competitive
solicitation request.
Staff requests approval to readvertise the project; however, if no bids, or a higher bid is received, the
County may have to solely fund the project.
PREVIOUS RELEVANT BOCC ACTION:
February 16, 2022 The BOCC approved by resolution the Florida Department of Transportation
(FDOT) Maintenance Memorandum of Agreement for the Florida Keys Overseas Heritage Trail
(FKOHT) Connection at Cudjoe Gardens project, requiring the County to maintain the project area.
January 21, 2022- The BOCC approved negotiations with WSP USA Inc., ranked the highest
respondent for the Construction Engineering and Inspection Services for the Florida Keys Overseas
Heritage Trail Connection at Cudjoe Gardens project.
June 16, 2021 The BOCC approved by Resolution a Florida Department of Transportation (FDOT)
Local Agency Program (LAP) grant agreement for the Florida Keys Overseas Heritage Trail
(FKOHT) Connection at Cudjoe Gardens project for construction in the amount of $284,936.00, and
construction engineering and inspection services in the amount of $45,000.00, for a total grant
amount of $329,936.00. The project is partially federally funded by FDOT through the Federal
Highway Administration (FHWA).
June 17, 2020 The BOCC approved Amendment 1 to the contract with CSA Central, Inc. for
Design and Permitting for the Florida Keys Overseas Heritage Trail (FKOHT) Connection at Cudjoe
Gardens project in the amount of $32,495.00, to provide South Florida Water Management District
and U.S. Army Corp of Engineers permit tasks related to compensatory wetland mitigation
requirements.
May 22, 2019 The BOCC approved a contract with CSA Central, Inc. for Design and Permitting
for the Florida Keys Overseas Heritage Trail (FKOHT) Connection at Cudjoe Gardens project in the
amount of $85,488.00.
October 17, 2018 - The BOCC approved by resolution an FDOT Local Agency Program (LAP)
grant agreement for Design and Permitting for the Florida Keys Overseas Heritage Trail (FKOHT)
Connection at Cudjoe Gardens project in the amount of $70,500.00.
