This First Amendment changes the location of the artwork, provides sixty days to finalize, and is a no cost change to the contract. ITEM BACKGROUND: Monroe County Ordinance No. 022-2001 provides for an appropriation of 1% of the construction costs for new construction exceeding $500,000 and renovations exceeding $100,000 to be set aside to promote understanding and awareness of the visual arts and enrich the public environment for residents and visitors. The new Plantation Key Courthouse and Detention Center is nearing completion. A Request for Proposals (RFP) was advertised and twenty-two (22) applicants submitted proposals. The AIPP Committee and non-voting stakeholders as the Selection Committee met on May 27, 2021, and seven (7) artists are recommended for approval. Based on responses submitted to the RFP on May 20, 2021, the AIPP Committee selected Lori Nozickto provide public artwork for the new Plantation Key Courthouse and Detention Center. The artwork consists of four (4) painted metal pieces each. The artwork was originally intended to hang on the elevator doors. Upon completion of the artwork it was determined that the elevator doors would need to be removed in order to have the artwork . It was also determined that the makeup/material of the artwork was not durable enough to handle being in such a high traffic/touch area. The artwork will instead be framed and hung on the adjacent walls. The Artist is also allowed an additional sixty (60) days from approval of the Amendment to finalize installation. There is no change in the contract cost with this amendment. AGREEMENT PLANTATION KEY COURTHOUSE AND DETENTION CENTER This First Amendment to Monroe County Art in Public Places Award Agreement, th Plantation Key Courthouse and Detention Center, is made and entered into this 20day of June, 2022, by and between the BOARD OF COUNTY COMMISSIONERS FOR MONROE COUNTY, hereinafter “County”/ “BOCC”, whose address is 1100 Simonton Street, Key West, Florida 33040, and LORI NOZICK, hereinafter “Artist”/’“Contractor”, whose address is now changed to 3450 Sawtelle Blvd., Apt. No. 119, Los Angeles, California 90066. WHEREAS, the parties hereto did on June 16, 2021, enter into a Monroe County Art in Public Places Award Agreement (“Award Agreement”) for the creation and installation of a unique piece of artwork at the Plantation Key Courthouse and Detention Center in Monroe County, Florida; and WHEREAS, pursuant to the Award Agreement, the Artist was to create and install four (4) elevator skins fabricated on steel/aluminum designed in shades of the sea and sky with colors of blues and greens with such installation to be on the elevators in the new Plantation Key Courthouse as per Paragraph 2, Scope of Services, of the Award Agreement; and WHEREAS, due to unforeseen circumstances as a result of the Covid-19 pandemic and other construction delays, the Artist was delayed, beyond her control, in installation of the elevator skins within the term of the Agreement; and WHEREAS, it was discovered on March 24, 2022, that the elevator skins could not be installed on the elevators with the doors in place and there was concern that if the doors were removed by the Contractor retained by the Artist for the installation that it could potentially void the warranty of the current contracted elevator company or that of the project Contractor, Biltmore Construction Company, Inc.; and WHEREAS, new locations were selected on the first and second floors of the Courthouse for installation of the elevator skins as four (4) framed pieces of abstract artwork rather than installing the elevator skins on the elevator doors in order to avoid any potential warranty issues; and WHEREAS, the Art in Public Places Committee held a special meeting on March 30, 2022, and approved the new selected locations and change in use of the artwork as framed abstract pieces rather than as elevator skins on the elevator doors; and WHEREAS, the Sixteenth Judicial Circuit Court was also consulted and are in agreement with the new selected locations for the framed abstract artworks; and 1 Buubdinfou;!GJSTU!BNFOENFOU!UP!BXBSE!BHSFFNFOU!XJUI!FYIJCJU!B!)gjobm!mfhbm!tubnqfe!'!bsujtu!tjhofe*!!)Gjstu!Bnfoenfou!.!Qmboubujpo Qbdlfu!Qh/!:82 D/42/c WHEREAS, this First Amendment is to amend the Award Agreement as to the Scope of Work to reflect the new locations and to revise the Scope of Work to allow for installation of the art as framed abstract artwork pieces rather than as elevator skins within sixty (60) days of approval of this First Amendment by the Board of County Commissioners; and WHEREAS, the Artist agrees and consents to such relocation and use of the abstract artworks as framed artwork pieces and to a revision of the Award Agreement reflecting such changes and the additional time for installation; and WHEREAS, the parties have found the Award Agreement to be mutually beneficial; and WHEREAS, the parties find it would be mutually beneficial to amend its original Award Agreement and enter into this First Amendment; NOW, THEREFORE, IN CONSIDERATION of the mutual promises and covenants set forth below, the parties agree as follows: 1. Paragraph 1, AGREEMENT PERIOD, of the Award Agreement is hereby amended to provide an additional sixty (60) days to the term of the agreement from the date of the approval of this First Amendment by the Board of County Commissioners for the Artist to complete framing and installation of the four (4) abstract artworks in the new selected locations on the first and second floors of the Plantation Key Courthouse. 2. Paragraph 2, SCOPE OF SERVICES, of the Award Agreement is hereby amended to delete the current Paragraph 2 as set forth in the Award Agreement, and replace it in its entirety with the following paragraph: 2. SCOPE OF SERVICES: The Artist shall perform all services, and provide and furnish all supplies, materials, and equipment as necessary for transportation, creation, and installation of artwork as follows: FOUR (4) STEEL (18 GAUGE) ABSTRACT ARTWORKS MEASURING APPROXIMATELY 6’ 8” x 3’ 6” FABRICATED ON STEEL DESIGNED PER ARTIST’S PROPOSAL IN SHADES OF THE SEA AND SKY – BLUES AND GREENS IN A PROCESS OF LAYERING COLORS, IRIDESCENT POWDERS, PATINAS AND SEALED WITH A UV PROTECTION AND GRAFFITI RESISTANCE SEALANT. Artist shall confer with and coordinate activities with Executive Director, Florida Keys Council of the Arts, Elizabeth Young, in order to ensure that there is as much cooperation and cohesiveness in the incorporation of the art in or around the building so that there shall be the least amount of interference between the Artist and the Plantation Key Courthouse and Detention Center personnel or any construction staff. 3.Except as set forth in Paragraphs 1 and 2 of this First Amendment to Award Agreement, in all other respects, the terms and conditions set forth in the Award Agreement, remain in full force and effect.
