ITEM BACKGROUND: on May 1, 2022. The County is required to have this policy because its primary liability policy specifically excludes healthcare services rendered by nurses. The current policy is provided by Illinois Union Insurance Company and has a per incident limit of $1,000,000, an annual aggregate limit of $3,000,000, and no deduc Retroactive Date of 4/26/07. The annual premium for the expiring policy is $23,000. Marsh USA, which , coverage to both Illinois Union and Markel Corporation. Both Illinois Union and Markel offered exactly mirror those of the current policy and those being offered by Illinois. However, none of the differences are viewed as being material. Markel proposed an annual premium of $16,500. Markel also enjoys a favorable rating from the A.M. Best Company. It should be noted that there are few insurers that offer this type of insurance. The proposed Markel coverage would not include punitive damages. However, this difference is immaterial to Monroe County, because under F.S. 768.28 (the statutory limited waiver of sovereign immunity for the state and local governments), governments are not liable for punitive damages. Since the terms and conditions of both proposals are essentially the same and that Markel offered a lower annual premium, it is recommended that the County purchase its Air Ambulance Nurses Medical Professional Liability Coverage with Markel Corporation with no deductible for the 5/1/22 to 5/1/23 policy term as being proposed by Marsh. Selecting this option represents a decrease of $6,500 (-28.2%).
