Ordinance 049-1996 " Planning Department ORDINANCE NO. 049 -1996 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS ADOPTING A FUTURE LAND USE MAP AMENDMENT CHANGING THE FUTURE LAND USE DESIGNATION FOR THE FLAMINGO INN =:MOTEL LEGALLY DESCRIBED AS DORSETT SUBDIVI~I~, LOTS 15, 16 AND THE SOUTHERN 25 FEET OF J:;oT 17 AND OLD STATE ROAD 4A ADJACENT TO LOT, 15, AT MILE MARKER 59.5, GRASSY KEY, MONROE COUNTY, FLORIDA AND HAVING THE REAL ~TATE IDENTIFICATION NUMBER 376290-000000 FROM RESIDENTIAL MEDIUM (RM) TO MIXED USE/COMMERCIAL (MU/C). ~ -Tl r f""'l c:::J 0 C":l -7' -I I i=) -.J --'J -;v -0 :"'1"": W r:; (;; 0 ::0 Vi t".::J WHEREAS, the Board of County Commissioners, on April 15, 1993, adopted the Monroe County Year 2010 Comprehensive Plan and therefore, designated the Flamingo Inn Motel located in Dorsett Subdivision on Lots 15, 16, the southern 25 feet of lot 17 and Old State Road 4A adjacent to lot 15 at mile marker 59.5 on Grassy Key, Monroe County, Florida as Residential Medium (RM) on the Future Land Use Maps; and WHEREAS, the applicant has requested a Future Land Use Map amendment for the above described property to change its future land use designation from Residential Medium (RM) to Mixed Use/Commercial (MU/C); and WHEREAS, the Planning and Environmental Resources Departments have reviewed the proposed future land use map changes and recom- mended approval; and FLAMINGO. 24/TXTAMAP Page 1 Initials WHEREAS, during the amendment process, the Development Review Committee, after due notice and public participation in the hear- ing process, has reviewed the proposed future land use map chang- es and recommended approval; and WHEREAS, during the amendment process, the Monroe County Planning Commission, sitting as the local planning agency, after due notice and public participation in the hearing process, has reviewed the proposed future land use map changes and the recom- mendations of the Planning and Environmental Resources Depart- ments and the Development Review Committee and recommended @.=. proval; and WHEREAS, the Monroe County Board of Commissioners, after due notice and public participation in the hearing process, has re- viewed all of the above recommendations; and WHEREAS, the Monroe County Board of Commissioners adopts the following findings of fact: 1. Based on site plans provided by the applicant and a site visit performed by staff, the property contains a 12-room motel that has existed since the mid-1970's; and 2. The existing zoning of the property is Improved Subdivision, which does not permit motels; and FLAMINGO. 24/TXTAMAP Page 2 Initials 3. The Board of County Commissioners directed the Growth Manage- ment staff to correct inadvertent conflicts between future land use designations and the existing zoning maps; and 4. The comprehensive plan states that existing hotels and motels are to be included in the Mixed Use/Commercial future land use category; and 5. The existing uses surrounding the motel include medium to high density, permanent and transient residential uses; and WHEREAS, the Monroe County Board of Commissioners adopts the following conclusions of law: 1. A policy requiring that the Future Land Use maps be consis- tent with existing zoning maps resulted in the translation of an error from the zoning to the Future Land Use maps for this proper- ty; and 2. The Mixed Use/Commercial FLUM designation of this property supports and furthers the overall goals, objectives and policies of the Monroe County Year 2010 Comprehensive Plan; and 3. The Mixed Use/Commercial FLUM designation of this property does not have an adverse impact on the community character; and FLAMINGO. 24/TXTAMAP Page 3 Initials NOW THEREFORE BE IT ORDINAINED BY THE BOARD OF COMMISSIONERS OF MONROE COUNTY, FLORIDA: THAT Section 1. This Board specifically adopts the findings of facts and conclusions of law stated above; and therefore Section 2. The previously described property, as shown on the attached map, which is hereby incorporated by reference, and attached as exhibit 1, shows that the property is currently desig- nated as Residential Medium (RM) and shall now be designated Mixed Use/Commercial (MU/C).
