An Attorney-Client Closed Executive Session of the Board of County Commissioners in the matter of
Florida Keys Citizens Coalition and Last Stand v. Department of Community Affairs and Monroe
County. FL. Case No. DOAR 06-2449GM.
ITEM BACKGROUND:
Two environmental groups, Florida Keys Citizens Coalition and Last Stand, have challenged the
Department of Community Affair's approval of five (5) Monroe County Ordinances implementing the
Tier System. The subject matter of the Closed Session will be confined to settlement negotiations or
strategy sessions related to litigation expenditures.
PREVIOUS RELEVANT BOCC ACTION:
On 10118/06, the Board authorized this closed session.

Assistant Coumty Attorney Jerry D. Sanders, and litigation counsel for the County Dave Jordan, Esq.,
Greenberg, TJraurig, P.A., and a certified court reporter. Tbe purpose of the Closed Session concerns
pending litiga,tion in the case of Florida KellS Citizens Coalition and Last Stand v. Deuartment of

presently a party.
