AGENDA ITEM WORDING: DISCUSSION of settlement of potential lawsuit by Lloyd Good
regarding transferability of development rights.
ITEM BACKGROUND: Mr. Good owns several lots on Sugarloaf Key. The lots in question are on
Sugarloaf Blvd and include potential marsh rabbit habitat. Good has indicated that he's considering
filing a declaratory judgment action to clarify his rights to transfer development rights off the lots. He's
received conflicting interpretations of the code from staff. Under his proposed settlement, the County
would confirm that he could sell the TDRs in question to a third party who will go through the
conditional use process to get approval to use those TDRs on a receiver site. Good would also deed
the property to the County. Staff has been unable to finalize the language of the settlement agreement
in time to present to the Board. Good has a proposed closing date prior to the next BOCC meeting.
