AGENDA ITEM WORDING: Approval to pay KW Resort Utilities Corporation (KWRU), the
balance of capacity reservation fees due them to upgrade the KWRU wastewater treatment plant to
advance wastewater treatment (AWT) standards.
ITEM BACKGROUND: As part of the Capacity Reservation and Infrastructure Contract between
Monroe County and KWRU, the Utility agreed to convert its wastewater treatment system to AWT (5-
5-3-1) by January 1, 2007. It was agreed that the Utility would retain $600 of the $2700 per EDU
capacity reservation fee to cover the incremental cost of conversion and initial AWT operation.
Further, Amendment Number One to the KWRU Capacity Reservation and hnfrastructure Contract
authorizes the County to pay the Utility $600 per EDU out of any lawfully available revenue source.
Since there have been delays in getting property owners to hook-up to the system, KWRU has
requested payment of the balance of capacity reservation fees due them to upgrade their plant to AWT
standards by January 1, 2007. See attached breakdown for balance due.
PREVIOUS RELEVANT BOCC ACTION: The Capacity Reservation and Infrastructure Contract
was entered into July 31s`, 2002. Amendment Number One to the KW Resort Utilities Corporation
Capacity Reservation and Infrastructure Contract was approved on 9/10/03.
