Code Enforcement Case CE06090198.
ITEM BACKGROUND:
In November 2006 the property owner, a general contractor, was served with a Notice of Violation of
MOlioe County Code Section 9,5-111(1), for enclosing a carport; remodeling the interior of his house;
installing new windows, doors, air conditioning, tile, plumbing, electrical, and a fence, all without a
building. On February 22, 2007, the Special Magistrate found the owner in violation. He was given
until March 22, 2007 to correct the violations by obtaining an after the fact permit, but he took no action
to do so. The County's lien was recorded in August 2007. However, in July 2007, Key West Bank
initiated foreclosure on the property. The foreclosure, which was complete in May 2008, had the effect
of extinguishing County's lien as to this property, but the County can proceed as to other property
owned by Mr. Harper. As of May 1, 2008, the fines amounted to approximately $36,000. No portion of
the fines or costs have been paid.
