Approval of Second Amendment to Contract to The Morganti Group contract for repair of the Marathon
Airport terminal.
ITEM BACKGROUND:
On October 19, 2006 the County entered into a contract with the Morganti Group for the Key West
International Airport -New Terminal Building and Renovation Project. As a result of the damage caused
by Hurricane Wilma and the health and safety issues it created at the Florida Keys Marathon Airport, on
March 15, 2006 the B.O.C.C. approved an amendment to the Morganti contract for Hurricane Damage
Repair Work to the Marathon Airport. In granting the work to the Morganti Group, the B.O.C.C., in
finding that an emergency existed at the Marathon Airport, invoked the exception to both state statute and
county code which requires pubic construction contracts be bid competitively. Due to the distinct nature of
the circumstances which led to the awarding of the original agreement and the awarding of the amendment
on an emergency basis, the amendment failed to distinguish among contract requirements for the Key West
and Marathon airports. Those issues are addressed here in the second amendment.
