ITEM BACKGROUND: The North Key Largo Utilities Corp. wastewater treatment facility
serves Ocean Reef, which is the only community in unincorporated Monroe required to procure
a building permit and pay pernu*tti*ng fees for advanced wastewater treatment upgrade; an other
entities have been previously exempted by State legislation. North Key Largo Utility Corp. is a
State registered not -for -profit corporation.. Ocean Reef has had a centralized wastewater
collection system in place since the 1970's.

MCC Sec.6-'108. Fees.
(a) Purpose. The purpose of this section is to establish the authority, -schedule, and
exemptions for permitting and related fees.
(b) Authority and fee schedule. Except as specifically established by this chapter, the board of
county commissioners may by resolution establish a fee schedule for, but not limited to, permit
applications, permits, plans examination, certificates of competency, re -inspections, permit
renewals, administrative fees, variance requests, and administrative appeals.
(c) Required. Except as authorized by this chapter, no permit shall be issued without payment
of all appropriate fees, Where a nonrefundable application fee is charged, the fee may be
applied to off -set the total permit fee at the time the permit is issued, except where the
application fee exceeds the total permit fee. In this case, the application fee shall become the
total permit fee.
(d) Exemptions. Fees may be exempted for only those entities and activities specifically listed
below:
(1) Conditional exemptions. The following governmental entities are exempt from county
building permit and application fees, but only if the listed entity does not charge the counter a fee
(including an impact fee) for development, environment, or similar permits, or for right-of-way
use:
a. The state, including the South Florida Water Management District;
b. The United States;
c. Municipalities wholly located within the county;
d. Energy services;
e. Florida Keys Electric Co-op; and
f. Florida Keys Aqueduct Authority.
(2) Full exemptions. The following entities or work are exempt from the county building permit
and application fees:
a. The county;
b. Volunteer fire departments;
c. Volunteer emergency medical departments; and
d. Construction of affordable housing projects, as defined under state statutes or part 11 of this
Code, receiving financial assistance from the county.
(e) Waivers. Not -for -profit organizations with 501(c)(3) status from the Internal Revenue
Service for construction of affordable or low income housing as defined by state statutes and
lessees of county -awned property for construction on such property may apply to the board of
county commissioners for fee waivers from the permit and application fees.
(f) Refunds. No fees paid for building permit fees shall be refunded without the approval of the
board of (.aunty commissioners upon the recommendation of the county administrator. Permit
application fees are not refundable.

The Florida Department of Environmental Protection (FDEP) is requiring all wastewater
r1eatment plants in Monroe County to be upgraded to meet advanced wastewater treatment
(A T) standards by July 1, 2010. This requirement is sinned at protecting the. marine ecosystem
of the Florida Keys.
North liK ey Fargo Utility (N1 LUQ has completed ted the plates to meet this requirement and has also
implemented wa-stewater revue for Irrigation rater for water conservation issues, The WWTP is
also expanded from the existing 0.55 mgd plant to 0.66 rngd. The existing and future effluent

Suzanne, I looked at this waiver issue some time back and drafted a proposed revision to Section 6-27(e) as
follows:
(e) Fee Waivers: The following entities may aaply to the board of county commissioners for fee waivers

(1) Not -for -profit organizations with a 501(c)(3) status from the Internal Revenue Service for
construction of affordable or low income housing as defined by Florida Statutes and lessees of
county -owned property for construction on said property

As a member -owned cooperative, NKLU is exempt from PSC jurisdiction. However,

(cooperatives) seems a natural extension of the public policy to benefit n - p
