ITEM BACKGROUND: The petitioners have requested abandonment of Carysfort Circle South in order to complete a wetland restoration project. The project consists of the restoration of 1.5 acres of historic wetland and removal of a portion of Carysfort Circle to reconnect tidal flow to the area. The petitioners would also construct a gate at the entrance of Carysfort Circle South to control access for law enforcement purposes. Except for one lot owned by one of the petitioners (Steve Klett), the property on either side of the road to be abandoned is titled in the name of the Board of Trustees of the Internal Improvement Trust Fund (DEP). WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to renounce and disclaim any right of the County and the public in and to the hereinafter described streets, alley-ways, roads or highways, and WHEREAS, under Chapter 336, Florida Statutes, it is necessary to hold a public hearing after publishing due notice of said hearing in accordance with said Chapter, now, therefore, BE IT RESOL VED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Board will hold a public hearing on October 21, 2009 at 3:00 P.M., or as soon as thereafter as may be heard, at the Harvey Government Center, 1200 Truman Avenue, Key West, Florida, to determine whether or not the Board will renounce and disclaim any right of the County and the public in and to the following described streets, alley-ways, roads or highways as delineated on the hereinafter described map or plat, to-wit: "A portion of the 50-foot wide right-of-way corridor ofCarysfort Circle, a public street according to the plat of Madeira Village as recorded in Plat Book 7, Page 12 of the public records of Monroe County, Florida. (Exhibit C-1 through C-9) Copies of Deed(s) - Petitioners certify that they are the sole owners of all lots on both sides of Carysfort Circle South, Madeira Village Subdivision, North Key Largo, Florida and that the abandonment of said road will not take away from other property holders' right of ingress and egress to their property. (Exhibit D) Legal description of that portion of roadway which petitioners seek to have abandoned. (Exhibits E-1 through E-3) Letters of no objection from utility companies. Including, but not limited to, water, electricity, telephone, and cable TV. (Exhibit F-1 through F-2) Letters of no objection from the two adjacent property owners and list of names and addresses of these two adjacent property owners. Petitioners seek the abandonment for the following reasons: (-~, ('" . tI .. '. .-. :.~ The road abandonment is needed to complete a wetland restoration project in Madeira Village Subdivision. Plans call for the restoration of 1.5 acres of historic wetland and removal of a portion of Carysfort Circle to reconnect tidal flow to the area (See Figure 1). The road also needs to be abandoned so a gate can be placed at the entrance to carysfort Circle South from County Road 905 to control access for law enforcement purposes. For years this stretch of road has been used for illegal dumping and drag racing. There have also been cases of individuals trespassing in restricted areas and driving vehicles into sensitive wetlands. The National Audubon Society, Inc., through its Keys Environmental Restoration Fund program, agrees to be responsible for and pay for the cost of advertising and recording fees incurred relative to this request for the vacation, not exceed $975.00. Petitioners further agree to grant any easement necessary for the furnishing of utilities, including without limitation, electric power, water, sewer, telephone, gas, cable and other electric communication services to the same extent as Is common within this area as to height, width and degree, upon request for such service or by the BOCC through its authorized agents. If easements are so required, copies of the executed documents will be provided to the County before the petition Is presented to the BOCC. Petitioners certify that the road to be abandoned does not end at water. The State of Florida Department of Environmental Protection, Division of Recreation and Parks, manages Dagny Johnson Key Largo Hammock Botanical State Park, which surrounds Carysfort Circle South from all sides. As the manager of this state park, I hereby certify that no property owner will be denied access to their property as a result of the abandonment of Carysfort Circle South, and I have no object to the abandonment of the said property.
