WHEREAS, Dean Parkinson submitted an application for administrative relief under Sec. 138-27 of the Monroe County Land Development Regulations; and WHEREAS, the Monroe County Board of County Commissioners makes the following findings of fact and conclusions of law: 1. The application for administrative relief from Dean Parkinson is for Lot 40, Block 4, Harris Ocean Park Estates, Key Largo in Monroe County, Florida having RE# 00448460.000000. 2. The date of the ROGO application is 9/7/2004. 3. The ROGO allocation application has been in the ROGO system for at least four (4) consecutive years and qualifies for administrative relief under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive Plan. 4. Monroe County Code (MCC) Section 138-27 provides a mechanism whereby an applicant who has not received an allocation award in ROGO may apply to the Board of County Commissioners for administrative relief. 5. The Board of County Commissioners (BOCC) has the authority to grant administrative relief under Section 138-27(f) and may grant the applicant a building allocation, offer to purchase the property at fair market value, or provide such other relief as may be necessary and appropriate. 6. The applicant applied for administrative relief on 4/13/2009, under Section 138-27 of the MCC and Policy 101.6.1 of the 2010 Comprehensive Plan. 7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be used for determining lands that are appropriate for acquisition and the criteria includes the environmental sensitivity of the vegetative habitat on the lot and the applicable Tier designation. The parcel is vegetated and 17 bounded by vacant, vegetated properties within the subdivision to the north, east and, west, 18 contiguous with a tropical hardwood hammock approximately 0.57 acres in size. To the south of 19 the subject property is a roadway. The submitted vegetation survey lists twenty-four (24) native 20 plant species, four (4) of which are listed as endangered or regionally important. The Monroe 21 County Protected Animal Species Map does not indicate threatened or endangered animals in this 22 area. 23 24 Relief Options under Administrative Relief: 25 The remedies available to the Board of County Commissioners for Administrative Relief 26 pursuant to Section 138-27 include: 27 28 a. All parcels listed as 426 (Tropical Hardwood Hammock) on the existing conditions map require that a habitat analysis be performed and that an evaluation index (HEI) be computed. The subject parcel is of the high hammock variety. SITE AND PROJECT DESCRIPTION: The site in question was inspected with Alex Score assisting/being trained on 7-2-2002 and resulted in the following: The site is bordered on the south by a paved roadway, Indian Avenue, the east and west by a wooded lot, and the north (rear) by houses. The parcel is vegetated with biota indicative of tropical hardwood hammock and the elevation indicates high hammock variety. The HEI was performed and submitted by Marcella Nemec for this lot, I agree with her findings, adding only the woody vine Chewstick to the species list. The species diversity is moderate, consisting of24 native woody species. There are 4 TIE/RI plants on the lot, Inkwood, Mahogany, two very rare Princewood trees and numerous rare Soldierwood trees. The hammock could serve as habitat for several TIE animals, however none were seen by Alex, Marcella or myself, and the site is not mapped habitat. Alex and I looked for Liguus tree snails, but saw none. There were several exotic species present including African Orchid and Purple Oysterplant. Less than 5 % of the site was invaded. The size of the parcel is small, only 5,025 square feet. The entire parcel appears relatively uniform in sensitivity. RECOMMENDA TION: The hammock was rated as low in quality. The open space ratio is .40, which will allow 3,015 square feet to be cleared, including the construction impact area of five feet width measured from the dripline or furthest extension of the house. (This clearing allowance will likely be reduced to only 40% clearing when the Tier ROGO is adopted, since this lot is in a proposed Tier 2 area.) A site preparation permit should be issued and the clearing and construction barriers field checked prior to validating the construction permit. All Purple Oysterplant and African Orchids should be removed from the site, and the other non-natives removed from the conservation areas on the lot. A transplant plan must be submitted for TIE and Rare plants, as well as any trees 4" or greater that will be removed for construction. Amended LDR Section 9.5-336 requires that as part of an application for approval of development on lands consisting of hardwood hammock or slash pinelands, the applicant prepare and submit a Habitat Evaluation Index (HEI) or stipulate that the habitat is high quality. The purpose of an HEI is to determine the quality of the habitat and the amount of allowable clearing area. The area outside of the clearing area is defined as "open space" and is to remain undisturbed. The amended LDRs require the property owner to record a conservation easement of their open space area. Specifically, Section 9.5-336 was amended to read: "Once a development permit has been issued and site preparations commenced, the habitat quality rating either resulting from the habitat analysis or from the applicant's stipulation of high quality shall remain in perpetuity and all future development of the parcel shall conform to the applicable pineland or hammock so analyzed or stipulated. This shall be assured by attachment of a deed restriction to run with the land, stating the amount of required open space." This will be accomplished by the "Grant of Conservation Easement Agreement" (GOCEA) which must be legally recorded prior to the issuance of a Certificate of Occupancy (CO) when construction is completed. The GOCEA will appear in the chain of title of the property once it is recorded. By recording a GOCEA, any subsequent owner of the property will be informed that specific portions of the land are solely for conservation purposes. A copy of the GOCEA is enclosed and the material should be self explanatory. However, if you need assistance contact my office. Certain sections of the GOCEA have been filled in for you and these sections should not be changed. " ~ounty of Monr~ Remember, the GOCEA is not due until you are ready for your CO. You will want to wait until near the end of construction to complete the GOCEA to assure that it accurately reflects the physical conditions on the property upon completion. For example, you may change your site plan in some way during the construction process and this could alter the area of your conservation easement. Before you request a CO, completely fill out the GOCEA, have it notarized, and submit it to the biologist in your area. Please leave the date on page 1 blank, it will be filled in when the Mayor signs it, and please use a blue pen for your signatures. For Item #3, Location of the Easement, a survey (reduced to 8 %" by 11" and sealed) must be attached as Exhibit "A" and a legal description with metes and bounds delineating that portion of the property subject to the easement is required. You will also need to submit a check made out to Monroe County Clerk of Courts for the recording fee and a self- addressed, stamped legal size envelope. The recording fee is $10.00 for the first 8W' by 11" page, plus $8.50 for each additional 8%" by 11" page. The presence of wild lime. wild coffee, and yellow root suggest that the project site has some potential as foraging and breeding habitat. However. the number and density of tropical hardwood hammock species onsite are not sufficient to qualify the site as suitable habitat. Wild lime and torchwood are preferred plant species for reproductive Schaus swallowtail butterflies and together are very important components of suitable habitat. The absence of wild lime on nearby lots suggests it is not abundant. Torchwood. a preferred plant species utilized by gravid Schaus swallowtail butterflies, is not present. Mosquito spraying, which negatively impacts butterflies, occurs regularly in this area. If replacement of native vegetation is required by the County, the Service recommends planting torchwood and wild lime where possible. Stock Island tree snails feed on wild tamarind (Lysiloma bahamensis), willow bustic (Sideroxy/om salicifolia), poisonwood, gumbo limbo, pigeon plum (Cocco/aba divers{fo/a), ironwood (Krugiodendronferreum), mastic (Mastichodendronfoetidissimum), wild lime, and strongbark (Bourreria sp). Several of these species were found onsite, but may not be present in a density that creates a microclimate (shade, humidity, temperature) favorable for tree snails. The hammock floor also may not have the attributes necessary for snail reproduction. If any tree snails are encountered during clearing for construction, the Service recommends they be relocated to nearby undisturbed hammock in accordance with County tree snail relocation protocol. The presence of the principal food source, poisonwood, and other food trees suggest the site may provide habitat for the State-listed white-crown pigeon. Determination Based on the information provided, we believe that your project, as described, is not likely to significantly increase adverse risk to any federally listed threatened or endangered species or critical habitat. Please note that Service review of this project in no way implies compliance with other Federal. State, county, or municipal regulations.
