Resolution 572A-2023 I RESOLUTION NO. 572A —2023 2 3 A RESOLUTION BY THE MONROE COUNTY BOARD 4 OF COUNTY COMMISSIONERS APPROVING THE 5 REQUEST FOR ADMINISTRATIVE RELIEF MADE BY 6 THOMAS ROTHDEUTSCH ON PROPERTY 7 DESCRIBED AS LOT 12, BLOCK 11, TROPICAL BAY 8 3RD ADD., BIG PINE KEY, RE 4 00314240-000000 IN 9 THE FORM OF A PURCHASE OFFER FROM THE 10 MONROE COUNTY LAND AUTHORITY. 11 12 13 WHEREAS, Thomas Rothdeutsch submitted an application for administrative 14 relief under Policy 101.7.1 of the Monroe County Year 2030 Comprehensive Plan; and 15 16 WHEREAS, the Department of Planning and Environmental Resources provided 17 a staff report to the Monroe County Board of County Commissioners regarding the 18 application; and 19 20 WHEREAS, the Monroe County Board of County Commissioners makes the 21 following findings of fact and conclusions of law: 22 23 1. The application for administrative relief from Thomas Rothdeutsch is for Lot 12, 24 Block 11, Tropical Bay 3rd Addition,Big Pine Key in Monroe County,Florida having 25 Real Estate No. 00314240-000000. 26 2. The date of the ROGO application is 05/29/2019. 27 3. The ROGO allocation application has been in the ROGO system for at least four (4) 28 consecutive years and qualifies for administrative relief under Policy 101.7.1 of the 29 Monroe County Year 2030 Comprehensive Plan. 30 4. Monroe County Code (MCC) Section 138-27 provides a mechanism whereby an 31 applicant who has not received an allocation award in ROGO may apply to the Board 32 of County Commissioners for administrative relief. 33 5. The Board of County Commissioners (BOCC) has the authority to grant 34 administrative relief under Policy 101.7.1 and may grant the applicant a building 35 allocation, offer to purchase the property at fair market value, or provide such other 36 relief as may be necessary and appropriate. 37 6. The applicant applied for administrative relief on 09/19/2023, under Section 138-27 38 of the MCC and Policy 101.7.1 of the Monroe County Year 2030 Comprehensive Plan. 39 7. Policy 101.7.1 and Policy 105.2.8 of the Monroe County Year 2030 Comprehensive 40 Plan provides criteria to be used for determining lands that are appropriate for 41 acquisition and the criteria includes the environmental sensitivity of the vegetative 42 habitat on the lot and the applicable Tier designation.
