Resolution 041-2024 2 3 � . 5 µdr 6 7 MONROE COUNTY, FLORIDA 8 MONROE COUNTY BOARD OF COUNTY COMMISSIONERS 9 RESOLUTION NO. 041-2024 10 11 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY 12 COMMISSIONERS SUPPORTING THE COLLABORATIVE 13 LEGSLATIVE PROPOSAL FOR ADDRESSING DERELICT VESSEL 14 ISSUES IN FLORIDA PREPARED BY A COALITION OF COUNTIES 15 INCLUDING MONROE COUNTY, MIAMI-DADE COUNTY, PINELLAS 16 COUNTY, HILLSBOROUGH COUNTY, AND THE WEST COAST 17 INLAND NAVIGATION DISTRICT REPRESENTING SARASOTA 18 COUNTY, MANATEE COUNTY, CHARLOTTE COUNTY, AND LEE 19 COUNTY. 20 21 22 WHEREAS,the Board of County Commissioners of Monroe County, Florida(hereinafter 23 "BOCC", "Board", or"Monroe County")is the governing body of Monroe County, Florida; and 24 25 WHEREAS, the State of Florida ("State") has since 1975 and 1979, respectively, made 26 unincorporated Monroe County a State-designated Area of Critical State Concern; and 27 28 WHEREAS, the waters surrounding the Florida Keys are situated within the boundaries 29 of the Florida Keys National Marine Sanctuary and have, since July 26, 2001, been designated a 30 federal No Discharge Zone by the United States Environmental Protection Agency pursuant to 31 Title 40, Chapter I, Subchapter D, Part 140, Section 140.4(b)(1)(ii), as may be amended from time 32 to time; and 33 34 WHEREAS, the wise stewardship of our environment involves the protection of the 35 marine environment for generations to come; and 36 37 WHEREAS, Monroe County has the highest number of derelict vessels in the state, 38 creating significant navigational safety issues, environmental impacts, and unnecessary financial 39 burdens for the residents of and visitors to the Florida Keys; and 40 41 WHEREAS, time is of the essence in addressing derelict vessels, as prolonged exposure 42 in the water and associated marine oceanic environment significantly raises costs, poses risks to 43 public safety, and causes harmful environmental impacts; and 44 45 WHEREAS,the West Coast Inland Navigation District("District"),representing Sarasota 46 County, Manatee County, Charlotte County, and Lee County, along with Monroe County, Miami- 1 of 3 47 Dade County, Pinellas County, and Hillsborough County, has formed a coalition ("Coalition") 48 representing these eight(8) coastal Florida counties to address longstanding issues hindering the 49 removal of derelict vessels in Florida waters; and 50 51 WHEREAS, six (6) counties within the Coalition rank in the top 10 for the number of 52 vessel registrations in the state of Florida, with four (4) of these counties ranking in the top five 53 for the most derelict vessels per the Florida Fish and Wildlife Commission's ("FWC") official 54 Derelict Vessel mapping application; and 55 56 WHEREAS, the Coalition has identified mission-critical concerns involving the State's 57 retention of vessel registration fees, the State's Derelict Vessel Grant Program ("DVGP") and the 58 FWC's implementation of the DVGP, and the timely processing of migrant vessels; 59 60 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 61 COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT: 62 63 Section 1. Recitals and Legislative Intent. The foregoing recitals and statements of 64 legislative intent are true and correct and are hereby incorporated as if fully 65 stated herein. 66 67 Section 2. The Monroe County Board of County Commissioners strongly supports 68 legislative efforts to effectively and expeditiously enact and approve the 69 legislative changes contained in the Collaborative Legislative Proposal for 70 Addressing Derelict Vessel Issues in Florida prepared by this Coalition 71 including Miami-Dade County, Pinellas County, Hillsborough County, and 72 the West Coast Inland Navigation District representing Sarasota County, 73 Manatee County, Charlotte County, and Lee County, as outlined in the 74 attached white paper presented and submitted by the Coalition. 75 76 Section 3. The BOCC directs the professional staff of the Planning and Environmental 77 Resources Department's Marine Resources Office to assist the Legislative 78 Affairs Office with the necessary steps toward accomplishment of this goal. 79 80 Section 4. The Clerk of Court for this Board shall furnish copies of this Resolution to 81 state representative James "Jim" Mooney and state senator Ana Maria 82 Rodriguez as soon as reasonably possible. 83 84 Section 5.
