A RESOLUTION AUTHORIZING THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA TO
Eifi'ER INTO A STIPULATION OF SETTLEMENT WITH

WHEREAS, on January 9, 1989, a civil action was filed on
behalf of Monroe County, Florida, seeking declaratory relief with
regard to the Principles for Guiding Development, (which civil
action was captioned Monroe County v. Governor Bob Graham, and
assigned Case No. 87-2169 in the Circuit Court for the Second
Judicial Circuit of Florida); and
WHEREAS, on June 27, 1988, the County (through its attorney,
David Paul Horan) entered into a stipulation of settlement of
this civil action, with the Department of Community Affairs of
the State of Florida, one of the defendants in that civil action;
and
WHEREAS, the Department of Community Affairs has fully and
satisfactorily completed its obligations under that stipulation
of settlement; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA that the Board hereby authorizes the
entering into of the stipulation of settlement between Monroe
County and the Department of Community Affairs and hereby
releases the Department of Community Affairs of the State of
Florida from any and all further obligations under the agreement
and stipulation of settlement, with regard to Case No. 87-2169.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 23rd day of May, 1989.
