RESOLUTION REVERSING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE, AND APPROVING THE
REQUEST OF WILL lAM H. AND BARBARA J .
DANTZSCHER TO REVERSE THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, DENYING A DIMENSIONAL VARIANCE OF
SEVEN FEET ON THE NORTH SIDE TO BUILD UP TO
13 FEET AND FOUR FEET ON THE EAST SIDE TO
BUILD UP TO 16 FEET.
WHEREAS, on August 9, 1985, the Board of Adjustment of
Monroe County, Florida, denied a dimensional variance of seven
feet on the north side to build up to 13 feet and four feet on
the east side to build up to 16 feet on the following described
property:
Lot 2, Coral Colony Subdivision, according to plat
thereof as recorded in Plat Book 3, Page 122 of the
Public Records of Monroe County, Florida. Located in
Section 6, Township 66 South, Range 33 East. Marathon,
Monroe County, Florida.
WHEREAS, William H. and Barbara J. Dantzscher have duly
appealed said decision to the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, and the
Board having reviewed the transcript of the August 9, 1985
hearing, having considered the argument of all parties present
wishing to speak on the matter, and all premises considered, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the August 9, 1985 decision of the Board of
Adjustment of Monroe County, Florida, denying a dimensional
variance of seven feet on the north side to build up to 13 feet
and four feet on the east side to build up to 16 feet for the
above-described property, be, and the same is hereby reversed.
2. That said William H. and Barbara J. Dantzscher be, and
they are hereby granted a reversal of the decision of the Board
of Adjustment of Monroe County, Florida, denying a dimensional
variance of seven feet on the north side to build up to 13
feet and four feet on the east side to build up to 16 feet on the
above-described property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 15th day of January
A.D. 1986.
