Resolution 029A-1986 't. ~ Kermit LewJ...u County Administrator RESOLUTION NO. 029A -1986 A RESOLUTION APPROVING A CONTRACT BETWEEN MONROE COUNTY AND JOHN R. COLLINS AS ACTING ADMINISTRATOR OF THE CODE ENFORCEMENT DEPART- MENT. WHEREAS, there is an immediate need to secure someone capable of administering and functioning as the acting head of the Code Enforcement Department; and WHEREAS, Florida Statute No. 162 permits and allows the appointment of someone to act in the capacity as representative of the administration of Monroe County in such office; and WHEREAS, John R. Collins has agreed to act as Acting Admin- istrator of the Code Enforcement Department and as such has entered into a contract on a temporary status for the same, which has been approved by the County Administrator and proposed to the Mayor and County Commission of Monroe County; now, BE IT RESOLVED BY THE MAYOR AND COUNTY COMMISSION OF MONROE COUNTY, FLORIDA, as follows: Section 1. That that certain contract by and between Monroe County and John R. Collins, a copy of which is affixed hereto, be and the same is hereby approved by the Mayor and County Commis- sion of Monroe County. Section 2. That the Mayor is hereby authorized to execute said contract for said County. AJJL , Clerk APPROVED AS TO FORM AND AL SUFFICtEt~ 8Y A~~r!; AGREEMENT FOR SERVICES THIS AGREEMENT, entered into by and between MONROE COUNTY, FLORIDA ( "County" ) , and. JOHN R. COLLINS ( "Contractor") , WITNESSETH: In and for the various covenants and understandings herein made, the County and the Contractor agree as follows: I. Contractor's Services: County and Contractor agree that Contractor shall provide to the County personal services as the Acting Administrator, Code Enforcement Department, of Monroe County, Florida. The personal services to be performed shall include: a. General supervision of, and authority over, the personnel assigned to the Code Enforcement Department, to include determination of all personnel's hours of employment, location where duties are to be performed, duties to be performed, and reconunendations for conunendation or discipline. Such general supervision shall be exercised in relation to all of the offices currently established by the County for the provision of Code Enforcement functions under the Code Enforcement Department. b. To perform generally those duties Florida Statutes or County Ordinances to the Administrator, Code Enforcement Department. assigned position by of c. To prepare and present to the Code Enforcement Board once each month, in an administrative capacity and not as a legal officer of the County, all cases and matters to be heard by and acted upon by the Code Enforcement Board. d. To conduct training sessions for all personnel assigned to the Code Enforcement Department as may be needed in the opinion of the Contractor, to include complaint ., investigation, case documentation, enforcement, presentation before the Code Enforcement Board. and case e. To provide such other services as may be mutually agreed upon by the County and the Contractor. County and Contractor further agree that Contractor shall provide such services, on an average, at a mimimum of sixteen (16) hours per week. Contractor's hourly computation shall include, and be computed as, all time spent in office attendance at any of the locations maintained by the County for the use of the Code Enforcement Department; travel time to and from, and attendance at, training sessions conducted by the Contractor; travel time to and from each of and all of the locations maintained by the County for the use of the Code Enforcement Department, and to hearing locations of the Code Enforcement Board; time spent in travelling to and from, and in attendance at, meetings or conferences related to the Code Enforcement Department at whatever location such meetings are held; travel time to and from, and time spent in liaison activities with, persons performing comparable functions for the City Of Key West, State Of Florida, or other counties within the State Of Florida, and with other personnel employed by the County. 2. Contractor's Compensation And Expenses. County and Contractor agree that Contractor shall be paid by the County at the rate of THIRTY-FIVE DOLLARS ($35.00) per hour. County and Contractor expressly agree that, for purposes of retirement, Worker's Compensation, Unemployment Compensation, and other Career Service benefits, Contractor is not eligible to receive same. Contractor shall be reimbursed for all expenses incurred in connection with the performance of personal services under this . . Agreement in accordance with the schedule and rates as set forth in Section 112.06l, Florida Statutes. Contractor is expressly authorized to utilize personal vehicle transportation in the performance of Contractor's duties under this Agreement. 3. County To Provide Office Space And Personnel. County agrees to provide Contractor with adequate office space, telephone serice, office supplies, and secretarial assistance for the efficient performance of Contractor's duties under this Agreement. County further agrees to provide Code Enforcement Officers to carry out the required day-to-day inspection and enforcement duties of the Code Enforcement Department. 4. Term Of Agreement. This Agreement is for a term of six months, commencing on January 28, 1986, at 9:00 A.M. and ending on July 27, 1986, at 5:00 P.M. County and Contractor agree that this Agreement may be terminated by either the County or Contractor upon seven (7) days written notice delivered to the other party. Such notice shall be delivered to the County by mail or hand-delivery to the office of the County Administrator, or shall be delivered to the Contractor by hand-delivery to the Code Enforcement Department office in the Public Service Building, Stock Island, Monroe County, Florida. 5. Entire Agreement. This Agreement constitutes the entire agreement between the County and Contractor, and may only be modified by mutual agreement in writing.
