RESOLUTION NO. 081-1986
RESOLUTION REVERSING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE, AND APPROVING THE
REQUEST OF K-MART CORPORATION TO REVERSE THE
DECISION OF THE BOARD OF ADJUSTMENT OF MONROE
COUNTY, FLORIDA, WHICH DENIED THREE VARIANCES
CONCERNING PARKING RATIO, PARKING SPACE SIZE
AND HANDICAP PARKING.
WHEREAS, on December 17, 1985, the Board of Adjustment of
Monroe County, Florida, denied three variances concerning parking
ratio, parking space size and handicap parking for the following
described property:
A parcel of land in Section 22, Township 61 South,
Range 39 East on Key Largo, Monroe County, Florida,
being a portion of "Industrial Acres," according to the
plat thereof, as recorded in Plat Book 5, Page 15, of
the Public Records of Monroe County, Florida, and being
more particularly described as follows: Lots 4 through
24, inclusive of Block 1; Lots 4 through 29 inclusive
of Block 2; Lots 4 through 35 inclusive of Block 3;
together with those portions of Naranja Road, Johnson
Road and the 20 foot wide alleys adjoining the above-
described lots as shown on said plat of "Industrial
Acres". Located on the Northbound (Oceanside) lane of
U.S. Ill, Mile Marker approximately 101.5, Key Largo.
Zoned RU-5 and BU-2.
WHEREAS, K-Mart Corporation has duly appealed said decision
to the Board of County Commissioners of Monroe County, Florida,
sitting as the Board of Appeals, and the Board having reviewed
.the transcript of the December 17 , 1985 hearing, having
considered the argument of all parties present wishing to speak
on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the December 17, 1985 decision of the Board of
Adjustment of Monroe County, Florida, denying three variances
concerning parking ratio, parking space size and handicap parking
for the above-described property, be, and the same is hereby
reversed.
2. That said K-Mart Corporation be, and it is hereby
granted a reversal of the decision of the Board of Adjustment of
Monroe County, Florida, denying three variances concerning
parking ratio, parking space size and handicap parking for the
above-described property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 19th day of March, A.D.
1986.
