RESOLUTION NO. 173-1986
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, DIRECTING
THE COUNTY ADMINISTRATOR TO REFUND THE SUM OF
FORTY-FIVE THOUSAND ONE HUNDRED SIXTY-FIVE
DOLLARS ($45,165.00) TO CORONA PROPERTIES OF
FLORIDA, INC., AND PROVIDING THAT THE SAME BE
TRANSFERRED FROM THE GENERAL FUND CONTINGENCY
ACCOUNT.
WHEREAS, the sum of Forty-Five Thousand One Hundred
Sixty-Five Dollars ($45,165.00) was paid to Monroe County by
Corona Properties of Florida, Inc. for Permit No. C-13757, and
WHEREAS, said Permit No. C-13757 was found to be illegal by
the Circuit Court of the Sixteenth Judicial Circuit, with such
finding being affirmed by the Third District Court of Appeal of
Florida, and
WHEREAS, since said Permit No. C-13757 is invalid, no fee
could be required for such an invalid permit, and
WHEREAS, the Courts aforementioned directed said sum to be
returned to Corona Properties of Florida, Inc., now, therefore,
BE IT RESOLVED BY THE MAYOR AND COUNTY COMMISSION OF MONROE
COUNTY, FLORIDA, as follows:
1. That the sum of Forty-Five Thousand One Hundred
Sixty-Five Dollars
($45,165.00) be reimbursed to Corona
Properties of Florida, Inc. as having been paid for the illegal
Permit No. C-13757, said refund being required by Order of Court.
2. That said sum of Forty-Five Thousand One Hundred Sixty-
Five Dollars ($45,165.00) be transferred from the General Fund
Contingency Account so as to make such refund.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 6th day of June, A.D. 1986.
