Resolution 238-1986 , .;:.~ RESOLUTION NO. 238 -1986 A RESOLUTION AUTHORIZING THE MONROE COUNTY DEPARTMENT OF BUILDING, PLANNING AND ZONING TO REFUSE TO ACCEPT ALL APPLICATIONS FOR DEVELOPMENT PERMITS COMMENCING TWO WEEKS PRIOR TO THE EFFECTIVE DATE OF THE RULE ADOPTING MONROE COUNTY'S COMPREHENS IVE LAND USE PLAN AND DEVELOPMENT REGULATIONS; PROVID- ING THAT UPON THE EXPIRATION OF THE TWO WEEKS DEVELOPMENT PERMIT APPLICATIONS SP~LL BE ACCEPTED FROM CERTIFIED CONTRACTORS; AND PROVIDING THAT UPON THE EXPIRATION OF AN ADDITIONAL TWO WEEKS DEVELOPMENT PERMIT APPLICATIONS SHALL BE ACCEPTED FROM ALL OTHERWISE QUALIFIED PERSONS. WHEREAS, it is desired to create a time gap before the effective date of the new Monroe County Comprehensive Land Use Plan and Development Regulations in order to allow for the processing of all permit applications then awaiting issuance under the current development regulations and to allow staff time to retool for processing applications under the new plan and regulations; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Commencing two weeks before the certified effective date of the Administration Commission rule adopting the Monroe County Comprehensive Land Use Plan and Development Regu- lations, the Monroe County Building, Planning and Zoning Depart- ment shall refuse to accept all applications for development permits. For the purposes of this Resolution, development permits are defined as described in Florida Statutes 380.031(4). Section 2. Upon the expiration of the period commencing two weeks prior to the effective date, as described in Section 1, the Monroe County Building, Planning and Zoning Department shall accept for processing development permit applications provided, however, that those applications are filed by State certified contractors or contractors certified under Chapter 6, Monroe County Code. Section 3. Upon the expiration of an additional two week period commencing upon the certified effective date described in Section 1, the Monroe County Building, Planning and Zoning Department shall than accept for processing development permit applications from all persons who are otherwise qualified under the appropriate statutes, ordinances, rules or regulations, to so apply.
